Will of Margaret Pressick of Whitby, Yorks, Spinster.

Dated 7.8.1838, proved 6.10.1841 at London.

This is the last Will and Testament of me Margaret Pressick of the Township of Ruswarp in the Parish of Whitby in the County of York Spinster I give all my household furniture plate linen china beds bedding and implements of household and all my books of every description and also all my cloaths and wearing apparel and every article and thing belonging to me which shall be in and about my dwelling house wherein I now reside at the time of my decease unto and equally between my Cousins Margaret and Elizabeth Lacy absolutely 

I give the sum of one thousand seven hundred and seventy five pounds part of my Capital in the three pounds per cent consolidated Bank Annuities unto my Cousins Edward Cayley and John Chapman (my executors hereinafter named) their executors administrators and assigns upon the trusts following that is to say 

In trust to pay the sum of sixty pounds part thereof to Esther Merchant 

the sum of sixty pounds other part thereof to John Eskdale of Whitby aforesaid Ship Carpenter 

the sum of sixty pounds other part thereof to Joseph Anderson of Whitby aforesaid Grocer (for the use of his children by his late wife formerly Esther Harrison Spinster) 

the sum of sixty pounds other part thereof to my Cousin the Reverend Thomas Alexander Brown 

the sum of sixty pounds other part thereof to my Cousin Charles Brown 

the sum of sixty pounds other part thereof to my Cousin George Brown 

the sum of one hundred pounds other part thereof to my Cousin Susan MacDowell 

the sum of three hundred pounds other part thereof unto and equally amongst the five children of my late Cousin Mary Wilkinson (formerly Mary Lacy Spinster) 

the sum of two hundred and forty pounds other part thereof unto and equally amongst the four daughters of my late Cousin Jessy Fenton 

the sum of three hundred and sixty pounds other part thereof unto and equally amongst the six daughters of my Cousin Jonathan Lacy 

the sum of sixty pounds other part thereof to my Cousin Rosina Lacy 

the sum of sixty pounds other part thereof to my Cousin Margaret Gossip 

the sum of one hundred and twenty pounds other part thereof unto and equally amongst John Harrison of Whitby aforesaid Mariner Esther Knaggs sister of the said John Harrison Esther Groves the wife of Robert Groves late of Whitby aforesaid Schoolmaster and Mary Winn the widow of Mark Winn of Whitby aforesaid deceased share and share alike 

the sum of one hundred pounds other part thereof to the Treasurer for the time being of the Society or Charitable establishment called the Seamans Fund in Whitby aforesaid 

the sum of twenty five pounds other part thereof to the Treasurer for the time being of the Charitable Institution or establishment called the Public Dispensary in Whitby aforesaid 

the sum of twenty five pounds other part thereof to the Treasurer for the time being of the Charitable Institution or establishment called the Female Charity in Whitby aforesaid 

and the sum of twenty five pounds the remainder of the said principal sum of one thousand seven hundred and seventy five pounds part of my said capital in the said three pounds per cent consolidated Bank Annuities to the Treasurer for the time being of the charitable establishment called the Girls School in Whitby aforesaid for the carrying on the benevolent intentions of these several charities respectively 

I give the sum of six thousand five hundred pounds part of my capital in the new three and a half per cent Bank Annuities unto the said Edward Cayley and John Chapman their executors administrators and assigns upon the trusts following that is to say 

As to the sum of one thousand four hundred pounds part thereof In trust to pay the dividends interest or yearly proceeds thereof when and as the same shall from time to time come in and be received unto my relation Elizabeth Spencer and her assigns during the term of her life 

and from and after her decease as to the sum of four hundred pounds part of the said principal sum of one thousand four hundred pounds In trust to pay the same unto Thomas Pressick the Son of the said Elizabeth Spencer his executors administrators and assigns absolutely 

And as to the sum of one thousand pounds the remainder of the said sum of one thousand four hundred pounds In trust to pay the dividends interest and yearly proceeds therefrom arising when and as the same shall from time to time come in and be received unto Rebecca Dodd the daughter of the said Elizabeth Spencer for and during the term of her life for her sole and separate use and I direct that the receipt of the said Rebecca Dodd alone notwithstanding her coverture shall be a sufficient discharge from time to time to my said trustees for the same & from and immediately after the decease of the said Rebecca Dodd I direct that the said sum of one thousand pounds principal monies shall be in trust for all and every the child and children of the said Rebecca Dodd who shall be then living in equal shares if more than one absolutely 

and as to the sum of three hundred pounds other part of the said Sum of six thousand five hundred pounds three and a half per cent Bank Annuities In trust for the said Thomas Pressick absolutely 

and as to the sum of three hundred pounds other part thereof In trust for the said Rebecca Dodd absolutely a

nd as to the sum of five hundred pounds other part thereof In trust for my cousin Jonathan Lacy his executors administrators and assigns absolutely 

as to the sum of five hundred pounds other part thereof In trust for my said cousin Margaret Lacy her executors administrators and assigns absolutely 

as to the sum of five hundred pounds other part In trust for my said cousin Elizabeth Lacy her executors administrators & assigns absolutely 

as to the sum of five hundred pounds other part thereof In trust for my Cousin Catherine the wife of John Adamson formerly Catherine Lacy Spinster absolutely 

as to the sum of three hundred pounds other part thereof In trust for my cousin William Lacy his executors administrators and assigns absolutely 

as to the sum of three hundred pounds other part thereof In trust for my Cousin Thomas Lacy his executors admninistrators and assigns absolutely 

as to the sum of five hundred pounds other part thereof In trust for my Cousin the said Edward Caley his executors administrators and assigns absolutely 

as to the sum of five hundred pounds other part thereof In trust for my cousin Margaret Chadwick absolutely 

As to the sum of two hundred pounds other part thereof In trust for my relation Sarah Wilkinson (the widow of George Wilkinson late of the City of London Merchant deceased) her executors administrators and assigns absolutely 

And as to the sum of two hundred pounds the remainder of the said sum of six thousand five hundred pounds three and a half per cent Bank Annuities In trust for my said cousin John Chapman absolutely 

I give devise and bequeath all that my part share or interest in the Chapel in Baxtergate in Whitby aforesaid commonly called the new Chapel with the pew or seat set apart in the said Chapel in respect thereof unto and to the use of my said cousin Jonathan Lacy his heirs and assigns for ever 

and I give and bequeath all my ready money and money out at interest upon securities or in the stocks or public funds (save and except the said several principal sums of one thousand seven hundred and seventy five pounds part of my capital in the three pounds per cent consolidated Bank Annuities and six thousand five hundred pounds new three and a half per cent Bank Annuities hereinbefore specifically bequeathed) and rest of my personal Estate unto the said Edward Cayley and John Chapman their executors administrators and assigns upon trust that they the said Edward Cayley and John Chapman do and shall as soon as conveniently may be after my decease sell and dispose of such part thereof as shall not consist of money and do and shall pay thereout my funeral and testamentary expences and debts and I declare and direct that the said Edward Cayley & John Chapman their executors administrators and assigns shall stand and be possessed of and interested in the residue of the money to arise & be produced from the personal estate last hereinbefore given to them Upon the trusts following that is to say 

as to one third part thereof In trust for the said Jonathan Lacy his executors administrators and assigns absolutely 

As to one other third part thereof In trust for the said Edward Cayley his executors administrators and assigns absolutely 

and as to the remaining one third part thereof In trust for the said Margaret Lacy and Elizabeth Lacy their several executors administrators and assigns in equal shares absolutely 

and in case of the death of the said Jonathan Lacy in my lifetime when in consequence of illness or from any other cause I may be unable to alter my Will I direct that the said sum of five hundred pounds hereinbefore given to him as aforesaid shall go to and be paid unto and equally amongst such of the daughters of the said Jonathan Lacy as shall be living and unmarried at my death and that the one third share of the said Jonathan Lacy of and in the said residue of my said personal estate and effects shall go to and be in trust for the six daughters of the said Jonathan Lacy share and share alike to whom in that case I give and bequeath the same respectively accordingly and I also direct in case of the death of any one or more of the other legatees under this my will in my lifetime in consequence whereof their said respective legacies may become lapsed that such legacies respectively shall sink into and become part of my personal estate and be divided along with the residue thereof in manner hereinbefore mentioned 

and I appoint the said Edward Cayley and John Chapman Executors of this my will and I declare that each of them respectively their respective executors and administrators shall not be answerable the one for the other of them and by no means for involving any losses and that they shall & may in the first place by and out of the said trust monies deduct and refund to themselves respectively all such costs charges and expences as they or either of them shall or may respectively sustain expend or be put unto by reason of the trusts hereby in them reposed and I do hereby revoke all former and other Wills by me at any time heretofore made In witness whereof I have to this my last Will and Testament contained in this and the four preceding sheets of paper set my hand that is to say my hand to the bottom of each of the said preceding sheets as well as to the foot or end of this fifth and last sheet thereof the seventh day of August in the year of our Lord one thousand eight hundred and thirty eight Margaret Pressick
