Will of William Porritt of Great Moorsholm, Yorks, Yeoman

Dated  22.01.1818, proved 9.06.1818 at York.



This is the last Will and Testament of me William Porritt of Great Moorsholm in Cleveland in the County of York Yeoman made this twenty second day of January in the year of our Lord One thousand eight hundred and eighteen. 

First I give and bequeath unto my Dear Wife Eleanor Porritt the sum of Five Pounds for her own Use to be paid to her immediately after my decease and also one Feather Bed and Bedding and Furniture sufficient for one Room 

I give and bequeath unto my Son Isaac Porritt the sum of Five Pounds to be paid to him within six calendar months after my decease 

I also give and bequeath unto my two Daughters Hannah Porritt and Eleanor Porritt the sum of Two hundred and Fifty pounds each to be paid to them at the times as hereinafter is mentioned (that is to say) the Sum of One hundred and Fifty pounds a piece to be paid to them within six calendar Months after my Decease and the remaining Sum of One hundred pounds a piece to be paid to them within six calendar months after the decease of my said Dear Wife but in case of the Death of my Daughter Eleanor before she attains the Age of twenty one years without leaving lawful Issue her surviving then and in that case I give the sum of Fifty pounds part thereof unto my said Daughter Hannah Porritt her Executors or Administrators and I give the remaining sum of Two hundred pounds unto my two Sons William Porritt and Joseph Porritt their Executors or Administrators Share and Share alike 

I also give and bequeath unto my said two Daughters Hannah Porritt and Eleanor Porritt and the Survivor or Survivors of them All the Remainder of my household Furniture Beds Bedding and Linen they giving to each of my said Sons William Porritt and Joseph Porritt one good Feather Bed and Bedding 

I give and Devise All my Messuages or Dwelling houses Farm Farmhold Lands Tenements Hereditaments and Premises situate at Moorsholm aforesaid unto and to the Use of my two Sons William Porritt and Joseph Porritt their Heirs and Assigns to take as Tenants in common and not as joint Tenants Subject to the payment thereout of the Legacies or Sums of Money hereinbefore given or bequeathed and one Annuity or clear Yearly Rent Charge or Annual Sum of Twelve pounds to be paid to my said Dear Wife Eleanor Porritt for and during the Term of her natural Life by four equal or even portions or payments in each year at or on the days or times following (that is to say) The twenty fifth day of March the twenty Fourth day of June the twenty ninth day of September and the twenty Fifth day of December in every year the first payment thereof to begin and be made on such of the said days as shall first happen after my Decease And that if the said Yearly rent or Annual sum of twelve pounds or any part thereof shall be in arrear or unpaid for the space of twenty one days next after any of the said days or times whereon the same ought to be paid as aforesaid then and at any time or times thereafter when and so often as the case shall so happen it may and shall be lawful to and for my said dear Wife Eleanor Porritt into and upon the said Messuages Lands Tenements and Hereditaments or into or upon any part or parts thereof to enter and distrain for the said Yearly rent or Annual Sum of Twelve pounds or so much thereof as shall be then in arrears or unpaid as aforesaid And all Costs charges and expences relating to or attending the said distress or distresses shall be fully satisfied and paid and in default thereof in due time after such distress or distresses shall be so taken to appraise sell and dispose of the same distress and distresses in like manner as in distresses taken for rent reserved by lease or common demise to the end and intent that thereby she my said dear Wife may be fully satisfied and paid the said Yearly rent or Annual Sum of Twelve pounds and all arrears thereof and all costs charges and expences relating to or attending the recovering or obtaining payment of the same 

And I give devise and bequeath unto my said Sons William Porritt and Joseph Porritt and to their Heirs and Assigns All such Real Estates as are now Vested in me upon any Trust or Trusts whatsoever To hold the same upon such and the like Trusts And as to all the rest Residue and Remainder of my ready Money and Money upon Securities of what nature kind or Quality soever and all other my real and personal Estate and Effects whatsoever and wheresoever whereof I shall die seized or possessed or be in any manner entitled to in Possession Reversion Remainder or Expectancy I give Devise and Bequeath the same unto my said two Sons William Porritt and Joseph Porritt their Heirs and Assigns Share and Share alike to take as Tenants in common and not as joint Tenants. 

I declare that the provision hereby made for my said dear Wife Eleanor Porritt is intended to be in lieu bar Recompence and full satisfaction of all Dower or Thirds or Right or Title of Dower or Thirds which she can or may claim or be entitled to of in to or out of all or any of my said real or personal Estate and Premises And I do hereby charge and make chargeable all and every my said real and Personal Estate and Effects with the payment thereout of all my just Debts Funeral and Testamentary Expences and the Expence of proving this my Will 

And I appoint my said two Sons William Porritt and Joseph Porritt joint Executors of this my Will hereby revoking and making void all former and other Will and Wills by me at any time heretofore made In Witness whereof I the said William Porritt the Testator have to this my last Will and Testament contained in this and the two preceeding Sheets of Paper hereto annexed set my Hand and Seal to wit my Hand at the Bottom of each of the said preceeding Sheets of Paper my Hand and Seal to this last Sheet and my Seal at the Top of the first of the said preceeding Sheets where all the said sheets are fixed together the day and Year first before written

I do hereby certify that on the 9th day of June in the year of our Lord 1818, William Porritt & Joseph Porritt, both of Great Moorsholm, Skelton in the County of York, Farmers, Sons & joint Executors named in this the last Will & Testament of William Porritt late of Great Moorsholm aforesaid in the Diocese of York, Yeoman, deceased, were sworn well & truly to execute & perform the same & that the whole of the goods, chattels & credits of the said deceased within the diocese of York do not amount in value to the sum of fifteen hundred pounds
