Will, Richmond Porritt, Mariner, Lambeth, Surrey (formerly of Whitby, Yorks) 

 

Dated 16.11.1811, proved 16.4.1812 at York.

Note that this will was also proved in London, 15.5.1812, and copy exists within the PCC records at Prob 11/1533 


This is the last Will and Testament of me Richmond Porritt late of Whitby, in the County of York, Mariner. 

In the first place, I do hereby constitute and appoint Mr Robert Burbank, Gentleman, and Mr Thomas Marwood, Merchant, both of Whitby aforesaid the Executors in trust of this my last Will, and I do hereby direct, that the said Executors in Trust shall pay or reimburse themselves, all such costs charges and expenses as they shall be necessarily put unto, in the execution of the trust hereby in them reposed, and that they shall not be accountable for any loss that may happen not through their wilful neglect or default; and I desire and direct the said Executors in Trust to take the care and management of all my principal monies, and all other my personal Estate and Effects of what nature or kind soever, and the Interest, Dividends and Profits arising therefrom, to be paid and applied by them in manner following, that is to say; 

the said Executors in trust shall from time to time, as the same shall be received by them, regularly pay unto my much honoured Mother Mary Hunter, now the wife of John Hunter late of Whitby aforesaid, Stationer (late Mary Porritt widow) for and during the Term of her natural life. All the Interest, Dividends and Profits arising from All and every the principal Monies and All other my personal Estate and Effects of what nature or kind soever hereby entrusted to their charge; and I direct that her receipt notwithstanding her coverture, shall be a good discharge for the same, and that the said Interest, Dividends and Profits shall not be under the controul of her said husband John Hunter or liable to pay any of his debts, but shall be at her own free and entire disposal same as if she was sole and unmarried; and on the death of my Mother, if that event should happen in and during the lifetime of her said husband John Hunter, then I give and bequeath to each of the said Executor in Trust, Robert Burbank and Thomas Marwood their heirs and administrators, Four hundred Pounds of lawful Money of Great Britain, and to Robert Guisburn, formerly apprentice to John Hunter of Whitby aforesaid Stationer, and son of _______ Guisburn Flaxdresser, I give and bequeath the sum of two hundred Pounds of like lawful Money, and as to all the rest residue and remainder of my personal Estate whatsoever and wheresoever I direct to be put and placed out at Interest in good security in the names of the said Robert Burbank and Thomas Marwood and three other respectable Gentlemen of Whitby aforesaid as Trustees of the said residue and remainder of my personal Estate, and the Interest arising therefrom to be applied in the following manner, under the direction and management of a committee of thirteen respectable Shipowners and merchants of Whitby, chosen by the Inhabitants of Whitby paying the poor Rates; that is to say, 

All the Interest arising from the aforesaid residue and remainder of my personal Estate (allowing all reasonable expences attending the management) to be for ever divided, distributed and paid to the following description of Persons, namely five Pounds per annum for life in half yearly payments to old and infirm Masters of Ships, and the Widows of Masters of Ships, who has in general been employed in the Merchant Ships of Whitby aforesaid, and who are resident at that place; the said Committee by their majority in the first selection and admission to this benefit as well as in vacancies that may occur, giving the preference only to the cases of most distress, join'd to a general good and decent character 

- But in Case my Mother Mary Hunter should survive her said husband John Hunter then and in such Case I give and bequeath to my said Mother Mary Hunter All and every my principal Monies, and all arrears of Interest due thereon, and All other my personal Estate and effects of what nature or kind soever to and for her own use and benefit, and at her own free and entire disposal, and I direct the aforesaid Executors in Trust to deliver up and transfer to my said Mother Mary Hunter all and every the Property hereby entrusted to their charge, and I make constitute and appoint my said Mother Mary Hunter sole Executrix and Residuary Legatee of this my last Will and Testament. 

In witness whereof I have hereunto set my hand and Seal this sixteenth day of November in the year of our Lord One Thousand eight hundred and eleven
