Extracted from the Registry of the Exchequer Court of York
This is the last Will and Testament of me Martha Porrett of Whitby in the County of York Spinster made & published as follows
First I direct that my just Debts Funeral Expenses and the Charges of proving this my Will be paid by my Executors hereinafter named out of my personal estate immediately after my decease And I give and bequeath unto my sister Margaret Page for her own use & benefit absolutely my Dining Table and Tea Table and best Chairs now in the house of my Brother Thomas Porrett
And I give and bequeath the remainder of my household Goods & furniture namely my bureau bed & bed hangings six Silver Tea Spoons Silver Sugar Tongs and silver Cream Pitcher unto my said brother Thomas Porrett for his own use & benefit during his life & after his decease I give and bequeath the same unto & equally to be divided in value amongst my four Nieces Elizabeth Hill the Wife of Isaiah Hill Mary Anderson the wife of James Anderson Mary Porrett and Elizabeth Owen and their respective Representatives the value of the same articles being to be ascertained by a competent person and in case of the said parties intitled thereto not being able to agree as to the parts thereof to be taken by them respectively then the same shall be drawn for by Lot
And I give & bequeath my Silver or own pocket piece unto my said Sister Margaret Page And I give & bequeath my cloaths & wearing Apparel unto my said four Nieces equally to be divided amongst them in the manner hereinbefore mentioned with respect to my household Furniture
And as to all the rest residue & remainder of my personal Estate & effects Monies & securities for money Stock in the Public Funds whatever else I may die possessed of I do hereby give & bequeath the same unto Mr John Ellerby of Whitby aforesaid Brewer his heirs Admors & assigns subject nevertheless to the payment of my just debts Funeral Expenses and the Charges of proving this my Will upon the ..... trusts following that is to say upon trust to ..... & place out the same at Interest upon good Government real or personal Security and to pay & apply the dividends Interest & proceeds thereof as the same shall arise and become due & payable unto my Brother Thomas Porrett & his assigns for & during the term of his natural life and from and after his decease Then upon further trust to call in the same Monies & effects and pay apply and divide the same unto and equally amongst my said four Nieces and the lawful Issue of such of them as may then happen to be dead leaving issue share and share alike as tenants in Common such issue taking only such share as his his her or their parent would have been intitled to if living
And do hereby nominate constitute & appoint the said John Ellerby and my Brother
Thomas Porrett Executors of this my Will and de hereby declare that it shall & may be lawful to and for them my said Executors & for the said
John Ellerby as such trustee as aforesaid to reimburse & satisfy themselves respectively all such costs charges and expenses as they shall respectively expend or be put unto in or about the execution of the Trusts and purposes of this my Will In Witness whereof I have hereunto set my hand and seal the Seventeenth day of April in the year of our Lord One Thousand Eight Hundred & thirteen The mark & seal of

Proved at London 3rd July 1813 before the Judge by the oaths of
John Ellerby and Thomas Porrett the Brother and exor to was granted being sworn by Comon only to Admr.
