Will & Inventory of Joseph Porrit of Great Moorsome, Yorks, Yeoman

Dated 15.10.1781, proved 2.6.1784 at York.


I Joseph Porrit of Great Moorsome in the parish of Skelton in Cleveland in the County of York Yeoman do make this my last Will and Testament in manner following (that is to say) 

I give to my Dear Wife Ann Porrit all such Household Goods, Linen and Furniture, as I now have, which were hers at the time of my Marriage with her I also Give and Devise to my said wife for and during the term of her natural Life All that my Messuage situate in Great Moorsome aforesaid wherein I now dwell with the appurtenances and from and after her decease I Give and Devise the said Messuage with the appurtenances unto my Son Francis Porrit his heirs and assigns for ever I also Give Devise and Bequeath to my said Wife for and during the term of her natural Life One Annuity or Yearly Rentcharge of Nine pounds of lawful money of Great Britain to be issuing and going forth and out of all and singular other my Messuages Farms Lands and Hereditaments situate lying or being within the Town Township or Territories of Great Moorsome aforesaid, and to be payable and paid to her my said Wife and her assigns for and during her natural Life as aforesaid upon the four days or times in each year hereinafter mentioned (that is to say) upon the first day of May, the first day of August, the first day of November and the first day of February in every year by even and equal portions Free and clear of and from all Charges and without any Abatement or Deduction of or for my Taxes Assessments or other Matter or thing imposed or to be imposed by authority of Parliament or otherwise howsoever The first payment thereof to begin and be made on such of the said days as shall first happen after my Death, And my Will and Mind is that in Case the said Annuity or yearly Rentcharge or any part thereof shall be behind and unpaid by the space of thirty days next over or after any of the said Days or times herein above appointed for the payment thereof that then and in such case and so often it shall and may be lawful to and for my said Wife and her assigns into and upon all and singular the same premises to Enter and Distrain and the Distress and Distresses then and there found and taken to lead drive chase carry away impound detain and keep until the said Annuity or Rentcharge so to be in arrear and all arrears thereof with the Charges to be occasioned by the nonpayment thereof shall be fully paid and satisfied and in default of payment thereof by the space of five days next after the taking of such Distress or Distresses then to sell the same and thereout to raise and pay such arrears with the Charges of such Distress and Sale Rendring the overplus, if any shall be, to the owner or owners of the Goods so to be distrained And my Will and Mind further is that if the said Annuity or Yearly Rentcharge of Nine pounds or any part thereof shall be behind and unpaid by the space of Forty days next over or after any of the said days or times hereinbefore appointed for payment thereof that then and in such Case and so often it shall and may be lawful to and for my said Wife and her assigns into all the said premises (charged with the said Annuity or yearly rentcharge as aforesaid ) or any part thereof to Enter and the same from the time of such Entry peaceably and quietly to hold and enjoy and to receive and take the Rents Issues and profits thereof to her and their own proper Use until she and they shall be thereout or therewith fully paid and satisfied the said Annuity or Rent charge and all arrears thereof and all such Costs and charges as she and they shall sustain or be put unto for or by reason of the non payment thereof 

I Give and Bequeath to my four Grandsons Joseph Porrit, Richard Porrit, William Porrit and Francis Porrit the sum of Fifty pounds apiece to be payable and paid to them respectively on their attaining their respective ages of twenty one years And if any of them shall happen to die under that age then the Legacy or Legacies of him or them so dying shall go and be paid to the Survivors or Survivor of them as and when the original Legacy or Legacies of such Survivors or Survivor shall become payable, if more than one, in equal shares and proportions 

I also Give and Bequeath to my two Grandaughters Miriam Porrit and Mary Porrit the sum of Ten pounds apiece to be payable and paid to them respectively on their attaining their respective ages of twenty one years and if either of them shall happen to die under that age then the Legacy of her so Dying shall go and be paid to the Survivor of them when the original Legacy of such Survivor shall become payable 

I also Give and Bequeath to my Son-in-Law William Ward the sum of Sixty pounds to be paid at the End of twelve Calendar Months next after the death of my said Wife 

And Subject to and charged with the payment of the said Annuity or Yearly rentcharge of nine pounds aforesaid as and to and with the payment of the said several Legacies in manner aforesaid, and also to and with the payment of all my Just Debts, I Give and Devise all and every my said last mentioned Messuages Farms Lands and Hereditaments with the appurtenances unto my said Son Francis Porrit his heirs and assigns for ever I also Give and Devise to my said Son Francis Porrit his heirs and assigns for ever all my Messuage Farm Lands and Hereditaments situate lying or being within the Township or Territories of Upleatham in Cleveland aforesaid in the said County of York I also Give and Bequeath to my said Son Francis Porrit all my ready money, securities for money, Goods Chattles and Personal Estate whatsoever (not hereinbefore otherwise disposed of ) he paying thereout my Funeral Expences 

And I appoint him my said Son Francis Porrit sole Executor of this my last Will and Testament And my Will and Mind is and I Do hereby Declare that what is hereinbefore given and Devised to my said Wife shall be in lieu and full satisfaction of her Dower and Thirds and all other her Claims and demands whatsoever forth or out of my Real and personal Estates or either of them. In Witness whereof I have hereunto set my hand and seal the fifteenth day of October in the twenty first year of the reign of George the Third now King of Great Britain etc. and in the Year of our Lord one thousand seven hundred and eighty one.....
