Will of George Porritt of Gilling, Yorks, Gentleman.

Dated 13.1.1830, proved 24.7.1830 at York.


This is the Last Will and Testament of me George Porritt of Gilling in the County of York Gentleman made this thirteenth day of January in the year of our Lord One Thousand Eight Hundred and Thirty as following (that is to say) 

I give and devise all my Messuage or Dwellinghouse with the Pen Yard Garden Outbuildings and Appurtenances thereunto belonging situate in the Parish of Gilling aforesaid unto and to the use of my Brother Henry Porritt of Togston in the County of Northumberland my Nephew Christopher Bulmer of Kirkby Hill in the said County of York and Ralph Atkinson Blackburn now residing with me at Gilling aforesaid their Heirs and Assigns In Trust to permit and suffer Elizabeth Meuers my present Housekeeper to hold and enjoy the same for and during the Term of her natural Life And from and after her Decease the said Messuage or Dwellinghouse with the Pen Yard Garden Outbuildings and Appurtenances thereto shall go to and be In Trust for the said Ralph Atkinson Blackburn his Heirs and Assigns for ever 

And I give and bequeath unto my said Trustees All my Plate Linen China Furniture and Household Effects in or about the said Messuage Dwellinghouse and Premises and usually enjoyed therewith In Trust to permit and suffer the said Elizabeth Meuers to use and enjoy the same for and during the Term of her natural Life And immediately from and after her Decease the said Plate Linen China Furniture and Household Effects shall go to and be In Trust for the said Ralph Atkinson Blackburn his Executors Administrators and Assigns for his and their absolute Use and Benefit 

And I give and bequeath unto the said Elizabeth Meuers All the Liquors and Household Provisions which shall be in or about my Dwellinghouse at the time of my Death 

And I give and devise unto the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Heirs and Assigns All my Messuages Cottages Lands Tenements and Hereditaments and all other my Real Estates whatsoever and wheresoever (except the Messuage or Dwellinghouse and Premises hereinbefore devised ) of or to which I or any person or Persons in Trust for me am is or are seized or possessed or of which I have any power to dispose or appoint with their Rights Members and Appurtenances (except such Estates as are vested in me upon any Trust or Trusts ) To Hold the same unto and to the use of them the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Heirs and Assigns Upon such Trusts and for such Intents and purposes as are hereinafter mentioned expressed or declared of and concerning the same And I give and bequeath all my Money Securities for Money Goods Chattels and other personal Estate not hereinbefore bequeathed or Disposed of unto the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Executors Administrators and Assigns Upon the Trusts and for the Intents and purposes hereinafter expressed and contained concerning the same And I do hereby declare my Will and Mind to be that my said Real and personal Estates lastly hereinbefore devised and bequeathed to the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Heirs Executors Administrators and Assigns and of which no Trust hath hereby been declared shall be upon Trust that they the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn and the Survivors and Survivor of them and the Heirs Executors Administrators and Assigns respectively of such Survivor do and shall with all convenient speed after my Decease call in and convert into Money my said personal Estate not specifically Disposed of or such part thereof as shall not consist of Money in the Funds or upon Real Security And do and shall absolutely sell or Dispose of my said Real Estates lastly hereinbefore devised together or in Parcels by public Sale or private Contract to any person or persons willing to become the purchaser or purchasers thereof respectively for such Price or Prices as to the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn or the Survivors or Survivor of them or the Heirs Executors Administrators or Assigns of such Survivor shall seem reasonable and for facilitating such Sale or Sales do and shall make enter into and execute all such Contracts Covenants Agreements Conveyances Assurances and things which to my said Trustees or the Survivors or Survivor of them or the Heirs Executors or Administrators of such Survivor shall seem reasonable And I do hereby declare that the Receipt or Receipts of the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn or the Survivors or Survivor of them or of the Heirs Executors Administrators or Assigns of such Survivor for any Money payable to them or him under this my Will shall effectually discharge the person or persons paying the same from being answerable or accountable for the Misapplication or Nonapplication thereof or of any part thereof or from being obliged to see to the Application thereof And I do hereby declare my Will and Mind to be that the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn and the Survivors or Survivor of them and the Executors Administrators and Assigns of such Survivor do and shall stand and be possessed of and interested in the Money to arise from the Sale or Sales hereinbefore by me directed to be made of my Real Estate or to arise and be produced from that part of my personal Estate which I have directed to be converted into Money And of and in any other Monies which I may be possessed of at the time of my death And of and in the Rents Issues and Profits of the Real Estates hereby directed to be sold until the same shall be disposed of and of and in the Interest of my Monies until the same shall become payable Upon the Trusts and for the Intents and purposes hereinafter expressed and declared (that is to say) In Trust in the first place to pay thereout all my just Debts Funeral and Testamentary Expenses And in the next place to pat thereout or appropriate at the end of twelve Calendar Months after my Decease the Legacies or Sums of Money hereinafter by this my Will given or bequeathed namely to my said Brother Henry Porritt the Sum of Four Hundred Pounds for his own proper Use and Benefit And to Such of the Children of my late Sister Mary Bulmer as are now living the Sum of Four Hundred Pounds to be equally divided amongst them Share and Share alike And to such of the Children of my late Sister Jane Atkinson as are now living the Sum of Forty Four pounds and eight Shillings apiece and to John Far Son of my late Niece Jane Atkinson the Sum of Forty four pounds and eight Shillings and to Elizabeth Watson and Atkinson Watson the Grandchildren of my said late Sister Jane the Sum of Twenty two pounds and four Shillings each 

And my Will and Mind is that my said Trustees shall stand possessed of the Sum of Four Hundred pounds other part of the said Trust Money In Trust to place out the same at Interest and to pay the Interest thereof to my Sister Ann Stradforth for and during her natural Life And immediately after her Decease the said last mentioned Sum of Four Hundred Pounds shall be divided and paid in the shares following that is to say To Margaret Meaburn Joseph Stradforth Rebecca Frend and Hannah Lee Children of my said Sister Ann Stradforth the Sum of Sixty Six Pounds twelve shillings and four pence each To Henry and Mary the Children of my late Niece Jane Bulmer the Sum of Thirty Three pounds six shillings and two pence each and to Mary Ann Bambro' Henry Meaburn and James Meaburn Children of my late Niece Ann Meaburn the Sum of Twenty two pounds four shillings and one penny each 

And I declare and direct that my said Trustees shall stand and be possessed of the Sum of Four Hundred pounds further part of the said Trust Money In Trust to pay the Interest thereof to my Sister Rebecca Elliott for and during her natural Life And immediately after her Decease the said last mentioned Sum of Four Hundred pounds shall go to and be divided between Christopher Elliott and Jane Reed Children of my said Sister Rebecca Share and Share alike 

And I further declare and direct that my said Trustees shall stand and be possessed of the sum of Five Hundred pounds other part of the said Trust Money In Trust to place out the same at Interest and to pay the interest thereof to the said Elizabeth Meuers for and during her natural Life And from and after her Decease the said sum of Five Hundred Pounds shall fall into and become part of the Residue of my personal Estate Provided always and my Will and Mind is that in case any of my Nephews and Nieces now living shall die after my Decease but before their respective Shares shall become payable then the Share or Shares of such of them so Dying shall go and be paid to their respective personal respresentatives And as to all the Rest and Residue of my Real and personal Estates whatsoever and wheresoever I give and devise and bequeath the same unto and to the Use of the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Heirs Executors Administrators and Assigns equally to be divided between and amongst them to and for their own Use and benefit as Tenants in Common and not as joint Tenants Provided always and my Will and Mind is that it shall be lawful for my said Trustees to pay the said Share hereinbefore bequeathed to my said Niece Mary Bulmer either at the end of twelve Calendar Months after my Death or at such other time or times as they may think fit anything hereinbefore contained to the contrary thereof in anywise notwithstanding Provided also and I do hereby declare that the Trustees for the time being of this my Will and each and every of them shall be charged and chargeable only for such monies as they shall respectively actually receive by Virtue of the Trusts hereby in them reposed notwithstanding their or any of their giving or signing or joining in giving or signing any Receipt or Receipts for the Sake of Conformity And that any one of them shall not be answerable or accountable for the others or other of them or for any involuntary lapses And that it shall and may be lawful for them with and out of the Monies which shall come to their respective Hands by Virtue of the Trusts aforesaid to retain to and reimburse themselves and to allow to their Cotrustee or Cotrustees all Costs Charges Damages and Expenses which they or any of them shall or may suffer sustain expend or be put unto in or about the Execution of the aforesaid Trusts or in relation thereunto And I give and devise unto the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn their Heirs and Assigns all such Real Estates as are now vested in me upon any Trust or Trusts or by way of Mortgage To Hold the same upon the Trusts affecting the same 

And Lastly I nominate constitute and appoint the said Henry Porritt Christopher Bulmer and Ralph Atkinson Blackburn Executors of this my Will hereby revoking and making void all former Wills and I do declare this only to be my Last Will and Testament In Witness whereof I the said George Porritt have to this my Last Will and Testament contained in this and the four preceding Sheets of Paper hereunto annexed set my Hand and Seal (to wit) my Hand to each of the said preceding Sheets and my Hand and Seal to this last Sheet the day and year first before written

I do hereby certify that on the sixth Day of July 1830 Christopher Bulmer of Kirby Hill in the County of York & Ralph Atkinson Blackburn of Gilling in the said County, Nephews & two Executors, named in the last Will & Testament of George Porritt late of Gilling in the County of York, Gentleman, Deceased, were sworn well & truly (power being reserved to Henry Porritt of Togston near Morpeth in the County of Northumberland Farmer) to execute & perform the same; and that the whole of the goods & chattels & credits of the said deceased, within the Province of York do not amount in value to the sum of Fifteen Hundred Pounds
