extracted from the Rigistry of the Exchequer Court of York
The last Will & Testament of me George Porritt of Whitby in the County of York Master Mariner in manner & form following that is to say
first I order all my just debts & funeral expences to be fully paid satisfied & discharged Also I give devise & bequeath unto my son William Porritt his heirs & assigns for ever to dispose of the same as he shall think proper all those my several messuages tenements shops & premises situate in Baxtergate in Whitby aforesaid
Also I give unto my said Son William all my books charts ......... & all ..... that belonge to me
also I give unto my Grandson Isaac Wilson & my Grand daughter Mary Wilson the sum of twenty pounds each to be paid unto them severally when they attain their ages of twenty one years and if either or both of them die before they attain their ages of twenty one years then I give the said legacy of him or her so dying unto my son William Porritt
Also I give unto my Son William Porritt the sum of five hundred pounds in the five per cent Bank of England Stock
Also i give Devise & bequeath unto my housekeeper Prudence Blackburn if she shall be living with me at my decease the sum of twenty pounds to be paid unto her at my death Also I give unto her one good suit of mourning Also I give unto her all my household goods beds & bedding & all my Linen that belongs to me Also I give unto the said Prudence Blackburn if she shall be living with me at my death the sum of twenty pounds a year paid yearly during the term of her natural life to be paid unto her by my Executors & trustees hereafter named half yearly the first half yearly payment to be made unto her six months after my death & after her decease I give the interest of the said sum of twenty pounds yearly unto my Son William during his life
Also i give devise & bequeath unto my friends Benjamin Gowland of Whitby aforesaid Gentleman & William Marwood the younger of Whitby Taylor all that my messuages or tenement & premises situate in ....... Street in Whitby aforesaid that I now live in Also i give devise & bequeath unto the said Benjamin Gowland & William Marwood the younger all other my goods chattells & effects whatsoever whether the same may be in Shares bonds mortgages or ..... public funds at the time of my death ......... to hold the same unto the said Benjamin Gowland & William Marwood the younger their executors admors & assigns upon this .... trust & ....... that is to say that .... the said trustees or the survivor or survivors of them or the executors admors of such survivor three months after my death sell & dispose of the said messuage or tenement that I now live in & the money arising by such sale to put and place the same out at interest on some good & sufficient Security in their own names in such manner as they shall think proper & also in trust that they so shall receive the interest & dividends of my money in the funds as the same shall become due & payable & pay & apply the said interest unto my Son William Porritt during the term of his natural life after payment of my debts funeral expences & the proving of this my will & from & after his decease to pay & apply the interest aforesaid unto & amongst the children of my said son William during the term of their natural lives & their children as long as any of them shall be in being until they severally attain their ages of twenty one years & then to divide the same amongst them share & share alike & if there be no such child or children living of my said Son William then I give the said principal sum & interest to be equally divided amongst ten of my nearest relations as shall be then living at their divide share & share alike & do hereby authorize & empower my said trustees & the Survivor & Survivors of them from time to time as often as they shall think proper to alter & change any of the said Securities and place the same out again as often as they shall think fit either upon Government Securities or otherwise & it is my will & meaning that my said trustees or either of them or the survivor or survivors or the heirs or Executors of such survivor shall not be liable to answer or make good any loss shall or may happen in putting & placing the same out at interest according to the directions of this my will unless the same shall appear to happen by or through their or other of their wilful neglect but each trustee shall only be answerable for his own ... deeds only & I do hereby direct my said trustees to reimburse himself & themselves of all expences that they maybe at in the execution of this my will & lastly I do hereby nominate & appoint the said Benjamin Gowland & William Marwood the younger Executors & trustees of this my last will hereby revoking all former wills by me made
In Witness whereof I also at the bottom of the first sheet of this my will the same being continued in two sheets and subscribed my name to the second or last my hand & seal this nineteenth day of January 1813
