Will of George Porrit, Elwick, Durham.

 

Written 1776, probate 1776, At Durham.

 

I George Porrit near Elwick in the parish of Hart in the County of Durham Yeoman do make this my last will and testement in manner following to say I give and devise to my sister Mary Porrit the sum of ten pounds a year for and dureing hir natural life to be paid quarterly from my death, free from deduction for and dureing her natural life. I allso give and devise to my sister Mary Porrit the south rome of the middle floor in my dwellen house at Elwick for her life. I give and devise to my brother Nicholas Porrit forty shillings a year for his life to be pd at two equal payment the first to be at the end of six months next after my decease, and from and after the decease of my brother Nicholas Porrit, I give and devise to the four daughters of my said brother Nicholas Porrit the summ of ten shillings a year a piece for and dureing their lives the first payment to begin and to be made at the end of one year next after the death of my said brother Nicholas.

     I give and devise to my brother Robert Porrit an annuity or yearly payment of twenty shillings for his life to be paid yearly without any deductions the first payment to be made at the end of one year next after my decease and from and after the death of my said brother Robert I give and devise the sum of ten shillings a year a piece to my said brother Robert’s two daughters, to be reckoned from the death of my said brother Robert to be paid them respectively yearly free from deduction.

     I give and devise to the son and daughter of my late brother John Porrit the sum of ten shillings a year a piece for and dureing their natureall lives to be paid them yearly without any deduction the firs payment to be at the end of one year next after my decease.

     I give and devise to Mary the daughter of my late brother Joseph Porrit the sum of twenty shillings a year  for hir life to be paid her yearly without any deduction to be reckoned from my death.

     I give and devise to Jane daughter of my late brother Joseph Porrit the sum of five pounds to be paid at the end of ten years next after my decease I give and devise to Ann daughter of my late brother Joseph Porrit the sum of twenty pounds to be paid at the end of ten years next after my decease, I give and devise to Rebeckah daughter of my late brother Joseph Porrit the sum of ten pounds to be paid her at the end of twelve years next after my decease.

     I give and devise to Henry son of my late brother Joseph Porrit a yearly annuity of twenty shillings for his life to be paid him respectively yearly without any deduction the first payment to be at the end of twelve years next after my death  I give and devise to John Porrit son of my late brother Joseph Porrit all that, all that parcell of ground I have in Whaley Moore containing by astimate five rouds or thereabouts be the same more or less, with all that percill of ground known by the name of Whorlton Park containing by estemate two acers or thereabouts be the same more or less situate near Elwick in the parish of Hart in the county of Durham he to enter on the same at the age of twenty eight years to him and his heirs for ever

     I give and dvise to Christopher Porrit son of my late brother Joseph Porrit all the dwelling house and percill of ground situate in Elwick in the parish of Hart in the county of Durham and in the possesion of John Sherinton as tenant their of to be entered on at my death to him and his heirs for ever.

     I give and devise to George Porrit son of my late brother Joseph Porrit all that dwelling house and percill of ground where I now live known by the name of the Three Noaked Close (or the Paddock) containing by estemate fifty five acers or thereabouts be the same more or less and to enter on the same when he shall arrive at the age of twenty eight years and for him and his heirs for ever.

I also desire and appoint that my nephew George Porrit when he shall arrive at the age of twenty eight years that he shall pay out of the estate that I have devised to him, the yearly annuity that I have devised to my sister Mary Porrit for her life, and that he also shall pay to my brother Nicholas the annuity that I have devised to him with the yearly annuity to my brother Nicholases daughters for their lives, with the yearly annuity that I have devised to my brother Robert and his daughters for their lives, and that he also shall pay to the son and daughter of my late brother John Porrit their annuity for and dureing their lives  I allso desire and appoint that my nephew John Porrit out of the estate that I have devised to him when he arrives at the age of twenty eight years shall pay the yearly annuity that I have devised to my nephew Henry Porrit for and during his life  I allso desire and appoint that my nephew Christopher Porrit that he out of the estate devised to him shall pay to his sister Mary Bulman the yearly annuity I have devised to her for her life, I charge and make liable all and every my freehold my copyhold messuages land tenament and heridatements at Elwick and elsewhere in the parish of Hart and in the parish of Bishop Middleham in the said County of Durham, with all my goods and chattles with all my rents and arrears of rent with the payment of all my just debts with the payment of the severall legacies by me devised in my will with the payment of all the several annuities, I give and devise all the said land tenement heridatement to the sole use of my nephew Christopher Porrit while his two brothers John and George shall arrive at the age of twenty eight years

     Provide any of those my nephews should dye before they should arrive at age the estate hinted to him shall decend and be equally devided amongst the sons of my late brother Joseph Porrit, and if any of my neices should so dye under age the annuity or legacy so hinted to them shall descend to the daughters of my late brother Joseph Porrit

     I constitute and appoint my said nephew Christopher Porrit, executor residuary legator of this my last will and testement in witness whereof I have hereunto set my hand and seall this twenty eight day of Aprill one thousand seven hundred and seventy six

In regard I have not surrendered my copyhold houses and primacies to the use of my will I declare it my intentions that in case my brother Nicholas Porrit and his heirs shall refuse on request to surrender the same to the use intents and purposes of my will above wrighten that then the severall devises in my will made and given to him my brother Nicholas and to his daughters shall be utterly void and shall not be raised and paid  And this publish and declare as a codicil to and part of my will, dated the twenty eight day of April one thousand seven hundred and seventy six
