In the name of God Amen I George Porrett of Scarbrough in the County of York Gentleman being not in health of body but of sound mind & memory praised be God do make & ordain this my last will & testament in manner & Form Following, Imprimis I give & devise unto my son
George Porrett & to his heirs & assignes for ever All & singular my messuages houses tenements & hereditaments whatsoever howsoever or wheresoever the same be scituate lying or being chargeable nevertheless & I do hereby make the same subject & lyable to the payment of the several sum or sums of money hereinafter mentioned (that is to say) with the payment of Ten pounds per Annum of lawfull money of Great Brittain to my loveing wife
Catherine Porrett for & dureing her natural life to be paid to her or her assignes at four quarterly days or times of payment in every year (that is to say) at Midsummer Michaelmas, Christmas & Ladyday by even & equal portions in lieu of such dower or thirds as she my said wife may or can have or claime out of all or any my said lands tenements or hereditaments, And for non payment of the said annual sum of Ten pounds or any part thereof at the days or times above limited for payment thereof or within ten days after every such quarterly day or time of payment as aforesaid it shall be lawfull & it is my will & mind that my said wife shall & may (after demands thereof made) enter into & upon all or any my said houses lands tenements or hereditaments & the same to detain & keep in her possession & receive the rents & profits thereof untill the said sum of ten pounds & all arrears thereof & all charges of such entry be fully paid & satisfyed, which said annual payment of ten pounds to my said wife I order to be paid to her as aforesaid clear of all taxes charges & outpayments whatsoever
and whereas I am obliged by contract upon marriage with my said wife Catherine to pay her daughter Ellice Burton the sum of fifty pounds, now to discharge myself of the said obligation I do hereby give & bequeath unto my said daughter in law Ellice Burton the sum of one hundred pounds of lawfull money of Great Brittain to be paid to her when she attains her age of one & twenty years & which when paid shall be in full satisfaction & discharge of the said sum of Fifty pounds which I was & am obliged to pay to her as aforesaid & with the payment of the said sum of One hundred pounds I do hereby charge my said lands tenements & hereditaments & make the same subject & lyable to the payment thereof,
Item I give & bequeath unto my daughter Elizabeth Porrett the sum of Two hundred pounds of like lawfull money of Great Brittain for & as her filiat or childs part or portion to be paid to her when she attains the age of twenty years & the interest thereof to goe forwards for her benefitt & advantage & towards her maintenance & Education till she attaines the said age, And with the payment of the said Legacy or portion to my said daughter Elizabeth I do also charge my said lands tenements & hereditaments above devised to my said son George & do make the same subject & lyable to the payment thereof,
And Lastly I do make nominate & appoint my said loveing wife Catherine Porrett & my son George Porrett joint executors of this my last will & testament to whom I give all my goods chattels & personall estate whatsoever of what kind soever it be after the payment of my just debts & Funerall Expenses,
And I do hereby further declare it to be my will & mind that for non payment of the said lagacys of One hundred pounds to my said daughter in law Ellice Burton or Two hundred pounds to my said daughter Elizabeth Porrett or either of them it shall & may be lawfull for them or either of them to enter into all or any part of my said lands tenements & hereditaments chargeable with the payment thereof as aforesaid & the possession thereof to hold & keep untill the same be fully paid & satisfyed with all charges of such entry,
And I give my brother William Porrett five pounds as legacy to be paid by my executors abovenamed within twelve months after my decease,
And I do appoint my said loveing wife & him my said brother William Porrett & my loveing Cozen Mr Timothy Fish to be tutors or guardians for my said Son & Daughter George & Elizabeth Porrett dureing their minority, And I do give each of them two guineas apeice for their trouble therein above what charges they may be at in seeing this my will duely performed,
And I give my Aunt Burton of Falsgrave a Guinea as a legacy to buy her a ring with,
In witness whereof I have to this my last will sett my hand & seal the nineteenth day of April Anno Dmi 1718.
