Will of Ruth Petty widow, of Whitby, Yorks.

Dated 23.6.1826, proved 9.2.1831 at York.


This is the last Will and Testament of me Ruth Petty of Whitby in the County of York Widow made the twenty third day of June in the Year of our Lord One thousand eight hundred and twenty six as follows. 

I give and bequeath All my household furniture Beds bedding Plate Linen and China Money securities for money and all other my personal estate and effects whatsoever and wheresoever whereof I may die possessed or be in any wise intitled to at the time of my death (subject nevertheless to the payment of my Just debts Funeral and Testamentary expences ) unto my Daughters Mary Harland wife of William Harland, Hannah Knaggs, widow, Ann Harland widow, Jane Porritt wife of Francis Porritt, Elizabeth Proddom wife of John Proddom and Ruth Walker wife of William Walker, equally to be divided between and amongst them, share and share alike. 

Provided always and i hereby direct my Executors hereinafter named to pay to my said Daughter Elizabeth Proddom out of her share hereinbefore by me given to her the sum of Four pounds a year and yearly during the term of her natural life or until such time as she shall have received the full amount of her said share, And in case my said Daughter Elizabeth shall happen to die before she shall have fully received her said share then and in such case I direct that the money which shall so remain due to and unpaid to her at the time of her death shall be paid and equally divided between and amongst all and every her child and children share and share alike, to be paid to them as and when they shall respectively attain their ages of twenty one years, the interest thereof in the mean time to be paid and applied towards their respective maintenance and education 

And I do hereby further declare and direct that in case any of my said daughters Mary Harland, Hannah Knaggs, Ann Harland Jane Porritt and Ruth Walker shall happen to die before they shall have received their respective shares hereinbefore by me given to them then and in such case the respective Share or Shares of her or them so dying as aforesaid shall be paid and equally divided to and amongst the respective children of her or them so dying as aforesaid, share and share alike, to be paid to them respectively as and when they shall respectively attain the age of twenty one years the interest thereof in the mean time to be paid and applied for and towards their respective maintenance education and benefit. 

And I appoint my Son in Law William Walker Sole executor of this my last will and testament and hereby revoke all former and other wills by me at any time heretofore made, And I hereby direct that my said Executor may deduct out of the monies which shall come to his hands all such costs charges and expences as he shall sustain or be put to in or about the execution of the trusts of this my will, And shall not be answerable for any involuntary loss. In witness whereof I the said Ruth Petty the testatrix have hereunto set my hand and seal the day and year first before written

I do hereby certify that, on the twenty sixth day of January in the year of our Lord 1831, William Walker, of Whitby, in the County of York, Cartwright (the son in Law, and sole Executor named in this the last Will and testament of Ruth Petty, late of Whitby aforesaid, in the Diocese of York, Widow deceased, was sworn well and truly to execute and perform the same, and that the whole of the goods, chattels, and credits of the said deceased, within the Diocese of York, do not amount in value to the sum of two hundred pounds - James Andrew, Surrogate
