In
the Name of God Amen I Tristram Fysh of Scarbrough in the County of
York Esqr being of sound mind and disposing memory but weak in body doe
make this my last Will and Testament in manner following First I Commit
my Soul into the hands of Almighty God who gave it And my Body to the
Earth to be buryed at the discretion of my Executor herein after named
And as touching my worldly Estate I dispose thereof as followeth
First I will and direct that my just debts and Funeral Expences be fully paid and satisfied
Item
I do hereby ratify and confirm unto my dear Mother her dower or thirds
which she is Entituled to have and receive out of all my reall Estates
during her life and subject thereto and Charged and Chargeable
therewith I do hereby give and devise unto my three Sisters Katherine
the wife of Mr John Coppinger Elizabeth the wife of Mr Cornelius Burgh
and Ann Fysh Spinster and their heirs All and every my Mannors
Messuages Lands Tenements and hereditaments whatsoever and wheresoever
scituate and being in the Kingdom of Great Britain or elsewhere or
whereof or wherein I am in any ways Seized possessed Interested or
Intituled To hold to my said Sisters Katherine Elizabeth and Anne and
their heirs for ever as Tenants in Common and not as Joynt Tenants
Item
I give to my two servants Elizabeth Ayre and Jeremiah Bewley Five
pounds apiece over and above the wages which shall be due to them at
the time of my decease
All the rest residue and remainder
of my Personal Estate be the same of what Nature or kind soever I give
and bequeath unto my said three Sisters to be equally divided between
them share and share alike
And I do hereby constitute and
appoint my said Brother in Law John Coppinger Sole Executor of this my
Will And do hereby revoke and make void all former and other Wills at
any time heretofore by me made and Executed In Witness whereof I have
hereunto set my hand and Seal the third day of January one thousand
seven hundred and thirty eight Tristram Fysh

Will was proved at London before the wppfull William Strahan Doctor of
Laws Surrogate of the Right wppfull John Bettesworth Doctor of Laws
Master Keeper or Commissary of the Prerogative Court of Canterbury
lawfully constituted the Sixth day of February in the year of Our Lord
one thousand seven hundred and thirty eight by the Oath of John
Coppinger Sole Executor in the said Will named to whom Administration
was granted of all and singular the Goods Chattells and Creditts of the
said deceased being first sworn duly to administer.'
