Will of Thomas Porrett Hayes, Russell Square, Middlesex. Gentleman.

Dated 23.1.1849, Proved at London 13th December 1850.

This is the last Will and Testament of me Thomas Porrett Hayes of Russell Square in the County of Middlesex Gentleman 

I give to my faithful Clerk William Kent the sum of three hundred pounds and to my present Coachman Footman Cook and housemaid Emily Ettridge ( if severally living with me at the time of my decease ) the sum of nineteen pounds nineteen shillings each which legacies & request may be paid by my executrix as soon as conveniently may be after my decease [ And I give all the fixtures furniture law books & law precedents in my office room in Bedford Row to my Partner Thomas William Budd

And I give my dwellinghouse in Russell Square & the Coach house and stable held therewith and also my one third share in the Conservative Clubhouse in Saint James's Street unto my dear and affectionate Wife Frances Isaac Hayes or her assigns for and during the term of her natural life for her use and benefit and from and after her decease I give and bequeath the same for all the remainder then to come of my terms in the said house coach house stable and clubhouse respectively unto my Nephew Robert Hayes his executors administrators and assigns In Trust with all convenient speed after the decease of my dear wife to sell and dispose of the same either by public auction or private contract as he or they may think proper and by and out of the money to arise form the sale thereof and with the rents and profits thereof from the decease of my Wife until the Sale thereof shall be completed to discharge all the expences of and attending such Sale and then by and out of the money to arise from the said Sale rents and profits to pay the following legacies to such of my Relatives next hereinafter named as shall be living at the the decease of my said Wife ( that is to say) 

To my Brother William Hayes the sum of five hundred pounds, to my Brother Robert Hayes the sum of five hundred pounds - to my niece Mary Hayes the sum of five hundred pounds, to my niece Margaret Curran the sum of five hundred pounds, to him my nephew Robert Hayes the sum of four hundred pounds, to my nephew Thomas Hayes the sum of four hundred pounds to my nephew Thomas William Hayes the sum of four hundred pounds , to my nephew Thomas Hayes Jackson the sum of five hundred pounds to my Cousins Mary Viner(?) and Deborah Viner(?) the sum of one hundred pounds each and to my nephew and nieces Edward Parker Sarah Golden and Maria Morrel the sum of one hundred pounds each and I direct that the said legacies to my Relatives shall be paid at the expiration of six Calendar months next after the decease of my said Wife but without interest 

and I declare and direct that the residue or surplus of the money to arise from the Sale of the said lease hold premises and from the rents thereof to arise after the decease of my Wife until the Sale of the same shall be completed shall be paid to my said two nieces Mary Hayes and Margaret Curran in equal shares and I also declare and direct that the legacies and money hereinbefore bequeathed to or in trust for my niece Margaret Curran shall be for her own sole and separate use benefit and disposal 

And I declare that the receipts of my nephew Robert Hayes his executors administrators or assigns shall be good and sufficient discharges to the purchasers of the said leasehold premises hereinbefore directed to be sold for the purchase monies in such receipts acknowledged to be received 

And I give and bequeath all my household goods plate china linen and furniture and all my ready money securities for money stock in the public funds annuities shares in the London and Westminster Bank Gas Shares shares and debentures in Railways and the rest residue and remainder of my property estate and effects whatsoever and wheresoever and of what nature or kind soever and not hereinbefore disposed of unto my Wife Frances Isaac Hayes her executors administrators and assigns for her and their own absolute use and benefit subject only to the payment of my debts funeral and testamentary expences and of the legacies to William Seal (?) and my said four Servants 

And I give all such real estates as shall be vested in me upon any mortgage or mortgages due to myself at the time of my decease to my said Wife her heirs and assigns to enable her with the greater ease to get in the money secured thereon for her own use [ And I give all such estates as shall be vested in me upon any trust or trusts at my decease to the said Thomas William Budd his heirs executors and administrators upon and subject to the trusts affecting the same 

And I appoint my said Wife Frances Isaac Hayes sole Executrix of this my Will In witness whereof I have hereunto set my hand and seal the twenty third day of January in the year of our Lord one thousand eight hundred and forty nine Thos Porrett Hayes
