Will of Scudamore Lazenby, London, Gentleman.
Dated 3.2.1758, proved at London 3.6.1760.
In the Name of God Amen I Scudamore Lazenby of London Gentleman make .. my last Will and Testament as follows (that is to say)
I
give devise and bequeath all that Messuage at Kingston Upon Hull now
divided into Two Tenements in the Tenure or Occupation of Mrs Jane
Lazenby and George Conyers And also all my Lands Tenements and
hereditaments at Ellerby in the Tenure of William ?Eman? which were
late the Estate and Inheritance of my Brother Jospeh Lazenby deceased
and are not in Jointure to Jane Lazenby his widow with their and every
of their appurtenances unto my Sister Dorothy Butler widow and her
Assigns during her life And after her decease unto my Sister Ann
Lazenby and her Assigns and after the decease of the Survivor of them
the said Dorothy Butler and Ann Lazenby then I Give and Devise the same
Messuages Lands hereditaments and premises unto my nephew Scudamore
Lazenby Clerk his heirs and Asigns for ever He and they paying thereout
within six months after he or they shall by Virtue of this my Will be
in actual possession and Intitled to the Rents and profits of the said
Messuages Lands Tenements hereditaments and premises hereby Given and
Devised to him and them as aforesaid the Sum of Five hundred pound of
Lawfull money of Great Britain unto my Two Neices Dorothy Butler and
Isabel Butler and the survivor of them And I do hereby charge the said
premises with the said sum of Five hundred pounds after the Death of
the survivor of them the said Dorothy Butler and Ann Lazenby
accordingly
And I Give Devise and Bequeath all and every my
Lands Tenements and hereditaments whatsoever situate lying and being in
or near Tunstall in Holderness late the estate and Inheritance of my
said brother Joseph and which are in Jointure to the said Jane Lazenby
with their and every of their appurtenances and the reversion and
remainder thereof in Fee simple Expectant on her Jointure or Estate for
life therein unto Leonard Lazenby son of my late Nephew Thomas Lazenby
and the heirs of his Body and in default of such Issue unto my nephew
Scudamore Lazenby and the heirs of his Body and in Default of such
Issue unto my own Right Heirs for ever
And I Give Devise and
bequeath unto Grace Hutchinson Aunt of the said Leonard Lazenby One
Annuity or yearly Rent charge of Fifteen pound of Lawfull Money of
Great Britain Free from all Deductions whatsoever during her life to be
Issuing out of and chargeable Upon the said Messuages Lands hereditts
and premisses hereinbefore Given and Devised unto or for the Benefit of
the said Leonard Lazenby as aforesaid to be paid by half yearly
payments the first payment thereof to begin and be made at the End of
Six Calendar months next after my Death And my Will is I do hereby
Direct that the said Grace Hutchinson Shall (subject to and without
prejudice to the Jointure Estate of the said Jane Lazenby) have and
Enjoy such powers and remedies for the better Securing and Recovering
the said Annuity or yearly Rent of Fifteen pound by Entry and distress
Upon and perception of the Rents and profits of the premisses
chargeable with the same as are usual in the Cases of Rents Charge
And
Whereas by the Settlement or Articles made on the Marriage of my late
Brother Joseph Lazenby a certain Sum of Money was agreed to be laid out
in the purchase of Lands and hereditaments to be settled for the use of
him for life and after his Death to the use of the said Jane Lazenby
now his widow for her life and after her Death to and for the use and
benefit of the Issue between them to be begotten in such manner as is
therein mencioned and for want of such Issue to the Right Heirs of my
said Brother And Whereas the said Money not having been laid out in the
purchase of Land pursuant to the said Articles or Settlement the same
did upon the Death of Jane Lazenby only child of my late Nephew Joseph
Lazenby under age and without Issue and Subject to the Estate and
Interest of the said Jane Lazenby thereon for her life) belong to me
and Fall under my Disposicion Now I do hereby Give and bequeath the
said Sum of money as agreed to be laid out as aforesaid And all my
Right Title Interest and Property of in or to the same Subject
Nevertheless as aforesaid unto my Executors hereinafter named in Trust
to pay Apply and Dispose of the same in manner and for the Purposes
hereinafter mentioned In Trust after the Death of the said Jane Lazenby
To pay the Sum of Four hundred pound part thereof unto Leonard Lazenby
his Executors Administrators and Assigns and Two hundred pound other
part thereof unto my Nephew Scudamore Lazenby his Executors
Administrators and Assigns And to Apply the residue and Surplus thereof
unto their own use and Benefit
And I Give and bequeath all my
ready Money Securitys for money Goods Chattels and personal Estate
whatsoever not herein before otherwise disposed of (subject
nevertheless to the Apyment of my Just Debts and Funeral Expences unto
my said Two Sisters Dorothy Butler and Ann Lazenby their executors
Administrators and Assigns to and for their own use and Benefit And I
make Constitute and Appoint my said Sisters Dorothy Butler and Ann
Lazenby Executors of this my Will And I do hereby Revoke all former
Wills by me made In Witness whereof I have hereunto set my hand and
Seal the third day of February One thousand Seven hundred Fifty

Will was proved at London the third day of June In the year of our Lord
One Thousand Seven hundred and Sixty before the Right Worshipfull
Edward ..mpson Doctor of Laws master ...per or Commissary of the
prerogative Court of Canterbury lawfully constituted by the Oaths of
Dorothy Butler widow and Ann Lazenby Spinster the Executrixes named in
the said Will to whom Administration was granted of all and Singular
the Goods Chattels and Credits of the deceased having been first Sworn
by Commission duly to Administer
