In the Name of God Amen I the Reverend Thomas Hayes vicar of Saint Oswalds Durham Do make this my last will and testament in manner following that is to say I desire that my Funeral may be like that of my late very dear Wife and
I give and bequeath all my money in the public funds and which shall be in my Bankers hands and in the hands of my Son Thomas and in my dwellinghouse at my decease and which shall be due to me from the Dean and Chapter of Durham and from my living of St Oswalds and which shall be due to me from any other source whatever at my decease to my Executors hereinafter named In Trust thereout to pay to pay my debts Funeral and testamentary Expences and then to divide the same amongst my three Sons and three Daughters

Ann Lawson and Sarah Parker in the following proportions that is to say as five bears to four for each of my said daughters and as four bears to five for each of my said Sons my intention being that they shall divide the same according to the rate of £250 apiece for each of my daughters and £200 apiece for each of my Sons and I give all my household goods plate china linen pictures prints Books manuscripts pianoforte watches rings trinkets and wearing apparel of myself and of my late dear Wife and my wines and liquors and all other my effects not herein before disposed of to my said three Sons and three daughters to be shared equally between them as they shall agree amongst themselves either to sell or appropriate the same or any parts thereof And I do appoint my Son
Thomas Porrett Hayes and my Son in Law George Frederick Louisa Nicholay Executors of this my will In witness whereof I have to this my last Will & testament all written with my own hand set my hand and seal this twenty fifth day of October in the year of our Lord one thousand eight hundred and Fourteen

I give to my Servant Elizabeth Ward in case she shall be in my Service at my decease the sum of thirty pounds over and above the wages that may be due to her as a compouration for her inviolable fidelity to myself and my late dear wife as witness my hand the 11th February 1819 Thos Hayes
Appeared personally Thomas John Alderson of Warnford Court Throgmorton Street in the City of London Gentleman and
James Griffith of Charles Street Westminster in the County of Middlesex Gentleman and made oath that they know and were well acquainted with the
Reverend Thomas Hayes late of the Parish of Saint Oswald in the town of Durham Clerk deceased for many years before and down to the time of his death and with his manner and character of handwriting and subscription having often seen him write and also write and subscribe his name and having now with care & attention viewed and perused the paper writing hereto annexed purporting to be and contain the last will and testament with a codicil thereto of the said deceased the said Will beginning thus In the Name of God Amen I the Reverend Thomas Hayes vicar of Saint Oswalds Durham ending thus In witness whereof I have to this my last will and testament all written with my own hand set my hand and seal this twenty fifth day of October in the year of our Lord one thousand eight hundred and fourteen and thus subscribed Thos Hayes the said codicil beginning thus I give to my Servant Elizabeth Ward and ending thus as witness my hand the 11th February 1819 and thus subscribed Thos Hayes they these deponents they do verily and in their consciences believe the whole body [???} and contents of the said Will beginning ending subscribed as aforesaid and also the said subscription to the said Codicil to be all of the proper handwriting and subscription of the said Reverend Thomas Hayes Clerk deceased and of no other person whatever Thos Jno Alderson James Griffith on the 16th day of June 1819 the said Thomas John Alderson and James Griffith were duly sworn to the truth of this affidavit before me
