Will of Esther Marchant of Whitby, Yorks.

Dated 4.7.1845, proved 24.2.1848 at York & 9.3.1848 at London.

This is the last Will and Testament of me Esther Marchant of Whitby in the County of York widow made the fourth day of July in the year of our Lord one thousand eight hundred and forty five as follows

First I give devise and bequeath to my Nephew John Eskdale all that my messuage or dwelling house now occupied in three tenements situate in Church Street in Whitby aforesaid now in the occupation of myself and of Jane Todd and Catherine ?..lesby my tenants to hold the same unto my said Nephew John Eskdale his heirs executors administrators and assigns for ever according to the nature of the tenure thereoff and I give and bequeath the following sums to the several persons hereinafter named (that is to say)

To my niece Esther Groves the sum of nineteen pounds nineteen shillings

To Elizabeth Miller of Whitby widow the sum of five pounds and to her children namely Benjamin Miller James Miller Elizabeth Wilson Mary Holiday Hannah Elders Wilson and Sarah Watson the sum of three pounds each which said legacies or sums of money I direct shall be paid to them within three calendar months after my decease and I give all my clothes and wearing apparel unto the said Elizabeth Miller widow to and for her own absolute use and benefit

And I give and bequeath all my ready money and money upon security and all my household goods and furniture plate linen china books pictures beds bedding and utensils of household and all other my real and personal estate and effects whatsoever and wheresoever and of what nature or kind soever unto and to the use of my said Nephew John Eskdale his heirs executors administrators and assigns according to the nature and tenure thereoff respectively But subject nevertheless to the payment of my just debts funeral and testamentary expences and the Legacies or sums of money hereinbefore by me given and bequeathed And with respect to my funeral I request the manner of my late husbands to be followed

And I nominate and appoint my said Nephew John Eskdale sole Executor of this my will and I hereby revoke all former and other wills and codicils by me at any time heretofore made In witness whereof I the said Testatrix Esther Marchant have hereunto set my hand the day and year first before written   The mark of Esther Marchant

The Will of Esther Marchant late of Whitby in the County of York widow deceased was proved at York the twenty fourth day of February in the year of our Lord one thousand eight hundred and forty eight before the Reverend Edward Raines Clerk surrogate of the Right Worshipful Granville Harcourt ....... Master of Arts Commissary and Keeper General of the Exchequer and Prerogative Court of York lawfully constituted by the oath of John Eskdale the sole Executor named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the said deceased he having been first sworn duly to administer Joseph Buckle Deputy Register

Proved at London 9th March 1848 before the Judge by the oath of John Eskdale the Nephew the sole executor to whom admon was granted having been first sworn by Commission duly to administer
