This is the last Will and Testament of me Andrew Perrott of the City of London Merchant
First
I will and Direct that all my just Debts Funeral and Testamentary
Expences and the Legacies hereinafter by me given and or bequeathed may
be in the first place paid and discharged by my Executors hereinafter
named out of my Personal Estate and Effects and I do hereby Direct my
said Executors to sell out and transfer so much and such part of my
three per cent Consolidated Bank Annuities which shall be standing in
my name in the Books kept by the Governor and Company of the Bank of
England at the time of my Decease as will be sufficient to answer and
pay for the Renewal of the Lease of such part of my Estate at
Osbaldwick next York which I hold by Lease for three lives
and
I do hereby Give Devise and Bequeath unto John Wilson of Old Bethlem in
the City of London Insurance Broker and Josiah Jowett of Capel Court
Bartholemew Lane in the said City of London Merchant their Heirs and
Assigns for ever all such and so much and such part and parts as is or
are Freehold and not Leasehold of all that my Manor of Osbaldwick near
the City of York aforesaid with all and singular the Rights Royalties
Members and appurts thereunto belonging or appertaining including and
comprizing all and every Messuages Farms Lands Tenements Tythes and
Heredits belonging to me situate lying and being at Osbaldwick and
Newbold in the County of York aforesaid or in any Township Parish or
place thereunto next or near adjoining or appertaining with their and
every of their Rights Royalties Members and Appurts To have and to hold
all such and so much and such part and parcel as are Freehold and not
Leasehold of the said Manor Messuages Farms Lands Tenements Heredits
and Premises hereinbefore devised with their Appurts unto the said John
Wilson and Josiah Jowett and their Heirs for ever To the use of them
and their heirs
Upon the Trusts and under and subject to the
Powers Provisoes and Limitations hereinafter expressed and declared of
and concerning the same (that is to say) In Trust for my Brother George
Perott of the City of York Apothecary and his Assigns for and during
the Term of his natural Life without Impeachment of waste and from and
after the Determination of that Estate To the use of the said John
Wilson and Josiah Jowett and their Heirs during the natural Life of my
said Brother George Perrott In Trust to support and preserve the
Contingent uses herein after limitted from being Defeated or Destroyed
and for that purpose to make Entries or bring Actions as the case shall
require yet nevertheless to permit and suffer my said Brother George
Perrott and his Assigns during his Life to receive and take the Rents
Issues and Profits thereof and of every part thereof to and for his and
their own use and benefit and from and after his Decease In Trust to
any one child or two or more Children of my said Brother George Perrott
lawfully to be begotten in such parts shares and proportions in Case
there shall be two or more such Children and for such Estate and
Estates and in such manner and by with under and subject to such powers
provisoes Conditions and Restitutions and with such Limitations over
but such Limitations over to be for the benefit of some or one of the
said Children as the said George Perrott at any time or times during
his Life by any Deed or Deeds Writing or Writings with or without power
of Revocation Sealed and Delivered by him in the presence of and or
attested by two or more Credible witnesses or by his last Will and
Testament in writing Signed by him in the presence of and attested by
three or more Credible Witnesses shall direct limit or appoint and in
Default of such Direction Limitation or appointment In Trust for all
and every the Child and Children of my said Brother George Perrott
lawfully to be begotten to be equally Divided between or among them if
more than one share and share alike to take as Tenants in Common and
not as Joint Tenants and the several and respective heirs of the bodies
of all and every such child and children lawfully issuing and in case
one or more of such children shall happen to die without issue of her
or their body or bodies then as to the share or shares of him her or
them so dying without issue in trust for the Survivors or Survivor and
others or other of them to be equally divided between or among them
them if mor ethan one share and share alike to take as tenants in
common and not as Joint tenants and the several and respective Heirs of
the Bodies of such Survivors or Survivor and others or other of them
and if all such Children but one shall happen to die without Issue of
their Bodies or if there shall be but one such Child In Trust for such
Surviving or only Child and the Heirs of his or her Body and for
Default of such Issue then In Trust for Thomas Perrott Son of John
Perrott of ?Perty? Street Rathbone Place in the County of Middlesex
Esquire and his Assigns for and during the Term of his natural Life
without Impeachment of waste and from and after the Determination of
that Estate to the use of the said John Wilson and Josiah Jowett and
their heirs during the natural Life of the said Thomas Perrott In Trust
to support and preserve the Contingent uses and Estates hereinafter
limitted from being Defeated or Destroyed and for that purpose to make
Entries or bring Actions as the Case shall require yet nevertheless to
permit and suffer the said Thomas Perrott and his Assigns during his
Life to service and take the Rents and profits thereof and of every
part thereof to and for his and their own use and benefit and from and
after his decease In Trust for the first second third Fourth fifth and
all and every other the Son and Sons of the Body of the said Thomas
Perrott lawfully begotten and to be begotten severally successively and
in Remainder one after another as they and every of them shall be in
Seniority of Age and priority of Birth and the several and respective
Heirs male of the Body and Bodies of all and every such Son and Sons
lawfully Issuing the Elder of such Sons and the Heirs Male of his Body
to be always preferred and to take before the younger of such Son and
Sons and the heirs Male of his and their Body and Bodies Issuing and
for Default of such Issue In Trust for George Perrott Son of George
Perrott of Pershore in the County of Worcester Esquire and his Asigns
for and during the Term of his natural Life without Impeachment of
waste and from and after the Determination of that Estate to the use of
the said John Wilson and Josiah Jowett and their Heirs during the
natural Life of the said George Perrott the Son of George Perrott of
Pershore aforesaid In Trust to support and preserve the contingent uses
and Estates herein after limited from being defeated or destroyed and
for that purpose to make entries or bring actions as the case shall
require yet nevertheless to permit and suffer the same George Perrott
the Son of George Perrott of Pershore aforesaid and his Assigns during
his Life to receive and take the Rents and Profits thereof and of every
part thereof to and for his and their own use and benefit and from and
after his Decease In Trust for the first second third Fourth Fifth and
all and every other the Son and Sons of the Body of the said George
Perrott Son of George Perrott of Pershore aforesaid lawfully begotten
and to be begotten severally successively and in Remainder one after
another as they and every of them shall be in Seniority of Age and
priority of Birth and the several and respective Heirs Male of the Body
and Bodies of all and every such Son and Sons lawfully Issuing the
Elder of such Sons and the Heirs Male of his Body to be always
preferred and to take before the younger of such Son and Sons and the
Heirs Male of his and their Body and Bodies Issuing and for Default of
such Issue In Trust for my own Right heirs for ever
And I do
hereby Give Devise and Bequeath all such and so much and such part and
parts as is or are Leasehold and not Freehold of all that my said Manor
of Osbaldwick with all and singular the Rights Royalties members and
Appurts thereunto belonging or appertaining including and Comprising
all and every Messuages Farms Lands Tenements Tithes and Heredits
belonging to me situate lying and being at Osbaldwick and Newbold
aforesaid in the said County of York or in any Township parish or place
thereunto next or near adjoining or appertaining with their and every
of their Rights Royalties Members and Appurts and all my Renewable and
other Estate Term and Interest therein unto and to the use of the said
John Wilson and Josiah Jowett their Heirs Executors Administrators and
Assigns respectively during the continuance of the Lease or respective
Leases by which the same is or are holden In Trust nevertheless for
such person and persons and for such Estates and for Interests and in
such proportions and manner and under and subject to such powers
Restrictions and Limitations as are hereinbefore expressed Limitted and
Declared or directed of and concerning the said hereinbefore Devised
Freehold part of the said Manor Messuages Farms Lands Tenements Tithes
and Heredits or as near thereto as may be and the nature of the said
several and respective Leasehold Estates will admit of To the end that
the same Leasehold Estates and Premises may be held and enjoyed and go
along with the said Freehold Estates and Premises so long as may be and
the Laws of England will permit and my Will is and I do hereby desire
and direct that the respective Leases which I now have or may have at
the time of my Decease of and in the said Leasehold premises
respectively shall and may from time to time when and so often as
occasion shall require after the first renewal thereof
hereinbefore Directed to be made from and out of my Personal Estate as
before mentioned be Renewed and filled up by and out of the Rents and
Profits of the same Premises or some part thereof in the Names or Name
of my said Trustees John Wilson and Josiah Jowett or the Survivor of
them or his Legal Representative And that all new and other Leases at
any time or times hereafter to be had or obtained of the same premises
as respectively shall at all times during the continuance thereof
respectively remain continue and be upon the like trusts and under and
subject to the like powers Restrictions and Limitations as are
hereinbefore expressed and directed or referred unto concerning the
Lease or Leases now in being of and in the same premises respectively
or as near thereto as may be and the Laws of England will permit
provided always and my Will is that it shall and may be lawful to and
for my said Brother George Perott and the said Thomas Perrott and
George Perrott son of George Perrott of Pershore aforesaid as and when
they shall respectively come into and be in the actual possession of my
said hereinbefore Devised Estates and Premises or any part thereof or
be actually intitled to the Rents and profits thereof or of any part
thereof by Indenture under their respective hands and Seals to Demise
or Lease the same or such part or parts thereof whereof they shall
respectively be in the actual possession or to the Rents and profits
whereof they shall be respectively entitled unto any person or persons
for any Term or number of years not exceeding twenty one years in
possession and not in Reversion Remainder or Expectancy so as upon
every of such Leases there be reserved and made payable during the
Continuance thereof respectively the best Improved Yearly Rent that can
be reasonably had for the same without taking any sum or sums of money
or other thing by way of Fine or Income for or in respect of such Lease
or Leases and so as none of the said Leases be made Dispunishable of
waste by any express words therein to be contained and that in every
such Lease there be contained a Clause of Reentry for non payment of
the Rent or Rents to be thereby respectively reserved and that such
Lessee and Lessees to whom such Lease ot Leases shall be made Seal and
Deliver Counterparts or their respective Leases
I do hereby
also Give Devise and Bequeath unto my said Brother the said George
Perrott his Heirs and Assigns all those my eight Freehold Closes called
Swinemore Closes near Swinemore Lane all lying within the Liberties of
the Town of Beverley in the said County of York and now in the Tenure
or occupation of John Thompson Robert Thorpe and Thomas Atkinson their
undertenants or Assigns To hold the same Closes with their appurts unto
and to the use of my said Brother of the said George Perrott his Heirs
and Assigns for ever
I do hereby also Give Devise and Bequeath
unto my said Brother George Perrott and the said John Wilson and Josiah
Jowett their Heirs and Assigns forever all that my Freehold Messuage or
Tenement and Farm together with the Lands and heredits thereunto
belonging or appertaining situate lying and being at Holme on the Wolds
near Beverley in the said County of York now in the Tenure of
Occupation of John Swift To Have and to hold the said Messuage or
Tenement and Farm Lands and Heredits last hereinbefore Devised with
their Appurts unto and to the use of my said Brother the said George
Perrott John Wilson and Josiah Jowett their Heirs and Assigns for ever
Upon the Trusts and for the ends intents and purposes hereinafter
expressed and declared of and concerning the same (that is to say) Upon
Trust that they my said Brother the said George Perrott and the said
John Wilson and Josiah Jowett or the Survivors or Survivor of them or
the Heirs or Assigns of such Survivor shall and do with all convenient
speed after my Decease absolutely sell and dispose of the said
Messuage or Tenement and Farm Lands and heredits last hereinbefore by
me given Devised and Bequeathed to them and the Fee Simple Inheritance
and Equity of Redemption thereof with the appurts either together or in
parcels unto any person or persons who shall be willing to become the
purchaser or purchasers thereof or of any part or parcel thereof for
the most Money and for the best price and prices that can or may be at
the time or times of such sale or sales and Disposition be reasonably
had or gotten for the same
And I do hereby Declare my Will and
Mind to be that the Receipt and Receipts of my said Brother George
Perrott and of the said John Wilson and Josiah Jowett or the Survivor
or Survivor of them his Heirs or Assigns under their or his hands or
hand respectively shall from time to time be a good and sufficient
discharge or good and Sufficient Discharges to the purchasor or
purchasors of the said last mentioned premises or any part thereof his
her or their Heirs Executors and Admons for so much of the said
Purchase Money for which such Receipt or Receipts shall be given and
such Purchasor or Purchasors shall be absolutely acquitted and
Discharged of and from the same and shall not be answerable or
accountable for any loss misapplication or nonapplication of the said
purchase money or any part thereof or be obliged to see to the
application or Disposition thereof or of any part thereof
And
I do hereby Will and direct that they my said Brother George Perrott
and the said John Wilson and Josiah Jowett and the Survivor or
Survivors of them and the heirs and assigns of such Survivor shall and
do in the first place by and out of the Money arising by sale of my
said last mentioned Estate and premises pay off and Discharge to Ann
Messon of Beverley aforesaid in the said County of York widow the sum
of one thousand one hundred pounds now due upon Mortgage of the said
last mentioned Messuage or Tenement and Farm Lands heredits and
premises hereinbefore by me given and devised In Trust to be sold as
aforesaid or so much thereof as shall be remaining due and unpaid to
her at the time of my Decease together with all Interest that shall at
the time of such payment be due and payable to her in respect thereof
and from and after full payment satisfaction and Discharge thereof and
of every part and parcel thereof respectively and of all Costs Charges
and expences of my said Trustees or Trustee in or about or relating to
the said Sale and the performance of the Trusts aforesaid upon Trust
that they my said Brother George Perrott and the said John Wilson and
Josiah Jowett and the Survivor and Survivors of them and the Heirs and
Assigns of such Survivor shall and do pay to or permit and suffer my
said Brother George Perrott his Executors Admors or Assigns to retain
the Residue or Overplus of the said purchase Money (if any) to his and
their own use and benefit absolutely and for ever
And I do
hereby Give Devise and Bequeath unto my Cousin the said George Perrott
the Elder of Pershore his Heirs and Assigns all those my Messuages or
Tenements together with the Lands Heredits and Appurts thereunto
belonging or appertaining situate lying and being at Laleham in the
County of Middlesex now or late in the several Tenures or Occupations
of ......... Greenhill Esquire John Green Jonathan ??Eimnell
Summersby?? and myself and also two other Messuages or Tenements lately
Inhabited by the Honourable George Perrott one of the Barons of his
Majestys Court of Exchequer and ......... Leman with the Rights members
and Appurts thereunto belonging or appertaining To hold the same
Messuages or Tenements Lands Heredits and Premises with their
Appurts unto and to the use of my said Cousin the said George
Perrott the Elder of Pershore his Heirs and Assigns for ever and I do
hereby Give and Bequeath unto my Cousin George Perrott the Elder of
Pershore his Executors Admors and Assigns all such part of the
Furniture Effects and things which shall be in and about the Messuage
or Tenement and Premises at Laleham aforesaid in my own occupation at
the time of my Decease and in which my Friend the said John Wilson is
not concerned as having purchased the same Jointly with me To have and
to hold the same unto my said Cousin George Perrott the Elder of
Pershore his Executors Admors and Assigns as and for his and their own
proper Goods Chattels and Effects absolutely and for ever
And
as to such part of the said Furniture Effects and things in and about
the said last mentioned Messuage or Tenement and Premises at Laleham as
I am interested in Jointly with the said John Wilson I Give and
Bequeath to the said John Wilson his Executors Admors and Assigns all
my Property and Interest therein
And I do hereby Give and
Bequeath unto my Friends the said John Wilson Josiah Jowett and
Randolph Hobman now a Clerk in the Bank the Sum of one hundred Pounds
each
And I do hereby Give and Bequeath to each of my Friends of the Little ??Bull Society?? a Mourning Ring each
And I do hereby Give and Bequeath unto the said John Wilson all my Fishing Rods and Tackle of all kinds
And I Give and Bequeath unto my Cousin Hannah Rennie of the City of York Widow the Sum of Fifty Pounds
And
I also Give and Bequeath to Francis Clowes and Mary Clowes Grand
Daughters of my late Aunt Prissick the Sum of Fifty Pounds each
and
I Give and Bequeath unto my Servant Sarah Goldhawke (if she shall be
living with me at the time of my Decease) the sum of twenty Pounds each
over and above what shall be due to her for Wages
All which
said several Legacies hereinbefore by me Given and Bequeathed I do
hereby Will and Direct shall be paid to the several Legatees before
named within six Months after my Decease
And all the Rest
Residue and Remainder of my Real and Personal Estate whatsoever and
wheresoever and of what nature kind or quality soever which I shall die
Seised or Possessed of or entitled unto I do hereby Give Devise and
Bequeath the same unto my Brother the said George Perrott his Heirs
Executors Admors and Assigns absolutely and for ever according to the
Different natures and Qualities thereof respectively to and for his and
their own use and benefit And I do hereby nominate constitute and
appoint my Brother the said George Perrott and the said John Wilson and
Josiah Jowett Executors of this my Will and my further Will is that
they my said Trustees and Executors and Admors shall not be charged or
chargeable with or accountable for any more of the aforesaid Trust
Estates Monies and Premises than they respectively shall actually
receive or shall come to their respective hands by virtue of this my
Will nor with or for any loss which shall happen of the same Estates
Monies and Premises or any part thereof so as such loss happen without
their wilful Defaultuor any one of them for the other or others of them
or for the Acts Deeds Receipts or Disbursements of the other or others
of them but each of them only for his own Acts Deeds Receipts and
Disbursements And also that it shall and may be lawful for them my said
Trustees and Executors and each and every of them their and each of
their Executors and Admors in the first place by and out of the
aforesaid respective Trust Estates Monies and Premises to deduct and
reimburse him and themselves respectively all such loss Costs Charges
and Expences as they or any of them shall respectively sustain Expend
or be put unto for or by reason of the said several Trusts hereby in
them reposed in relation to the same Estates Monies and Premises
respectively or the Management and Execution thereof or any other thing
in any wise relating thereunto And lastly I do hereby revoke annul and
make void all and every Will and Wills by me at any time or times
heretofore made and do make publish and declare this only to be my last
Will and Testament In witness whereof I the said Andrew Perrott the
Testator have hereunto set my hand and Seal the ninth Day of August in
the Year of our Lord one thousand seven hundred and eighty eight

This
Will was proved at London the ninth Day of February in the year of our
Lord one thousand seven hundred and ninety three before the Worshipful
George Harris Doctor of Laws and Surrogate of the Right Honourable Sir
William Wynne Knight also Doctor of Laws Master Keeper or Commissary of
the Prerogative Court of Canterbury lawfully constituted by George
Perrott the Brother of the Deceased and John Wilson and Josiah Jowett
the Executors named in the said Will to whom Administration of all and
singular the Goods Chattels and Credits of the said Deceased was
granted the said George Perrott and Josiah Jowett having been first
sworn and the said John Wilson having already made a solemn and sincere
declaration or Affirmation according to Act of Parliament duly to
Administer
