This
Indenture made the Eighteenth day of May in the yeare of our Lord
(according to the comon accompt and computation of the Church of
England) one thousand six hundred fifty eight betweene Micheall Pressicke of Maltby in the County of Yorke yeoman and Mary his wife on the one party And George Wilcocke
of Hemlington in the said County of Yorke and Bartholomew Milburne of
Marton in the County aforesaid yeomen on the other party:
Witnesseth that the said Micheall Pressicke and Mary his wife
for and in consideration of the sume of three hundred and two pounds of
good and lawfull money of England to them in hand paid or secured to be
paid by them the said George Wilcocke and Bartholomew Milburne
or the one of them before the ensealling and delivery of these presents
have given granted bargained sold aliened infeoffed and confirmed and
by these presents doe clearely frely and absolutely give grant bargaine
sell aliene infeoffe and confirme unto them the said George Wilcocke and Bartholomew Milburne their heires and assignes for ever All that their messuage or tenement in Maltby aforesaid wherein they the said Micheall Pressicke and Mary
his wife now live And those two Closes Garthes Tofts or Crofts neare
adjoyning to the said messuage or tenement and lying on the South Side
thereof contayning by Estimation one acre and a halfe be they more or
lesse which he the said Michaell Pressicke purchased of one Christopher Lownsdale of Maltby aforesaid
And
alsoe all those closes land or parcels of ground within the precincts
of Maltby aforesaid as the same is now divided into three parts comonly
called or knowne by the name of Law Fields which lye North of the
publique street called Ladgate way containeing by Estimation Thirty
Eight acres be the same more or lesse Together with all and singular
houses Edifices buildings barnes Stables Oxehouses Outhouses Orchards
garthes Gardens lands tenements Tofts crofts Meadowes pastures feedings
wayes waters water courses hedges hedge Rowes Easements profits
comodityes hereditaments Emoluments and Appurtnances whatsoever To the
said Messuage or Tenement Closes Tofts Crofts lands and parcels of
ground and every or any of them belonging or in anyway or wise
appertaineinge or accepted reputed deemed taken or knowne as part
parcell or member thereof or of any part thereof And alsoe more
pticularly fre liberty of ingresse egresse and regresse for them the
said George Wilcocke and Bartholomew Milburne
their heires and Assignes and their servants from time to time and at
all times for ever hereafter with all manner of Cattell and Cariages of
their or any of their whatsoever into and through the lands and
tenements of Christopher Pressicke and John Pressicke
in Maltby aforesaid comonly called the Garthes & flatt to or from
the grounds called the Lawfields or any part thereof when and as often
as need shall require And the Rewcon and Rewcons Remainder and
Remainders rents profits and issues of all and singular the said
premises and every or any part thereof which said premises now are in
the tenure or occupation of him the said Michaell Pressicke and Mary his wife their or the one of their Assignee or Assignes
To
have and to hold the aforesaid Messuage or Tenement Closes Tofts or
Crofts thereunto belonging the Closes called Lawfields and all and
singular other the before granted premises with their and every of
their rights members and Appurtenances and every part and parcell
thereof unto them the said George Wilcocke and Bartholomew Milburne their heires and Assignes for ever to the onely sole proper use benefitt and behoofe of them the said George Wilcocke and Bartholomew Milburne their heires and Assignes for ever And the said Micheall Pressicke and Mary
his wife doe by these presents Covenant promise and grant for them
selves their heires Executors and Administrators and every of them to
and with them the said George Wilcocke and Bartholomew Milburne their heires and Assignes and every of them by these presents in manner and forme following that is to say that they the said Michaell Pressicke and Mary
his wife or the one of them are or is at the time of the ensealling and
delivery of these presents lawfully soly and absolutely seized of a
good sure sufficient lawfull and absolute Estate of Inheritance in fee
simple without any manner of Mortgage limitation of Estate defeazance
or other condition whatsoever to alter change defeat or detamine the
same of in and upon all and singular the before granted premises with
Thappurtnances and every part and parcell thereof And that they or the
one of them have or hath good right full power and Lawfull and absolute
Authority to give grant bargaine sell aliene infeoffe and confirme the
same unto them the said George Wilcocke and Bartholomew Milburne their heires and Assignes for ever
And that it shall and may be lawfull to and for them the said George Wilcocke and Bartholomew Milburne
their heires and assignes from time to time and at all times for ever
hereafter peaceably and quietly to have hold occupy possesse and enjoy
all and singular the before granted premises with their and every of
their appurtnances and every part and parcell thereof without the
lawfull lett sute trouble ejeccon eviccon disturbance claime or demand
of them the said Michaell Pressicke and Mary
his wife or either of them their or either of their heires or Assignes
or of any other person or persons whatsoever Cleare and free and
clearely and frely acquitted exonerated and discharged or otherwise
from time to time and at all times hereafter well and sufficiently
warranted defended saved and kept harmelesse by them the said Micheall Pressicke and Mary
his wife their heires Executors Administrators or Assignes or some of
them of and from all and all manner of former and other bargaines sales
...... grantes Leases joyntures tytle and tytles of dowers uses wils
intayles fees Annuity or rents arreareages of rents Intrusions fynes
amerciaments statute merchant and of the Staple Recognizances
Judgements Extents Executions forfeitures seizures and reprisals and of
and from all other tytles troubles charges and incumbrances whatsoever
(the rents and services from henceforth to become due and payable to
the Chief Lord or Lords of the fee or fees of the premises onely
excepted and foreprized) And moreover that they the said Micheall Pressicke and Mary
his wife and their heires and every other person and person and persons
now haveing or claimeing or which at any time or times hereafter shall
have or claime any just right tytle or interest of in or to the
aforesaid granted premises wth thappurtnances or any part thereof shall
and will at any time hereafter dureing the space of Tenn yeares next
ensuieing the date hereof at and upon the reasonable request and proper
costs and charges in the law of them the said George Wilcocke and Bartholomew Milburne
or either of them their or or either of their heires or Assignes or any
of them make doe acknowledge execute and suffer or cause to be made
done acknowledged Executed or suffered all and onely such further and
other lawfull and reasonable act and acts thing and things devise and
devises Assureance and conveyances whatsoever for the further better
and more perfect assureing surety pure makeing and conveying of all and
singular the aforesaid Messuage or tenement and all other the before
granted premises wth their and every of their Appurtnances unto them
the said George Wilcocke and Bartholomew Milburne
their heires and Assignes for ever according to the true intent and
meaneing of these presents as by their either or any of their Councell
or Councels learned in the lawes of this lande shall be reasonably
devised advised or required Be it by fyne or fynes feoffement Recovery
or Recoveryes with single or double voucher or vouchers deed or deeds
inroled or not inroled thinrolement of these presents release or
confirmation without warranty or with such warranty as hereafter in and
by these presents is mentioned and Expressed and by all these wayes and
meanes or by any of them or by any other lawfull or reasonable wayes or
meanes whatsoever soe that they the sayd Micheall Pressicke Mary his wife
their heires or assignes nor any other person or persons whatsoever soe
haveing or claimeing the before granted premises wth thappurtnances or
any part thereof be not compelled to travell further than the City of
Yorke Castle of Yorke or County of the same for or about the makeing
doeing acknowledgeing Executeing or suffering of the said Assureance or
Assureances conveyance or conveyances or any of them All which
said fyne or fynes feoffement and other Assureance or Assureances
conveyance or conveyances soe to be had made levyed acknowledged
Executed or suffered of the aforesaid premises with thappurtnances or
any part thereof shall be deemed Esteemed and taken by vertue of these
presents to be and ..... to the onely sole proper use benefitt and
behoofe of them the said George Wilocke and Bartholomew Milburne their heires and Assignes for ever and to noe other use or uses whatsoever And the said Micheall Pressicke and Mary his wife
and their heires or Assignes the aforesaid Messuage or tenement and all
and singular the before bargained premises with thappurtnances and
every part and parcell thereof unto them the said George Wilcocke and Bartholomew Milburne their heires and Assignes against them the said Micheall Pressicke and Mary his wife
and either of them their and either of their heires and Assignes and

The condition of this obligation is such that if the above bounden Micheall Pressicke
his heires Executors & Administrators & every of them shall and
will from time to time & at all times hereafter well & truly
observe performe fulfill and keep or cause to be well and truly
observed performed fulfild & kept all & singular the Covenants
promises grants and agreements which on this and their parts and
behalves are and ought to be observed performed fulfild & kept
mentioned & conteyned in one Indenture beareing date .... these
presents (purporting the bargaine and sale of one Messuage or tenement
& halfe an oxgange of land in Newby wth in the County of Yorke)
made betweene the abovenamed Micheall Pressicke
on the one part & the above sayd Bartholomew Milburne of the other
part according to the true intent Effort & meaning of the sayd
Indenture that then this present obligation to be voyd & of none
effect or els to stand & abide in full force & vertue in the law
