 Woodmass v Brown

Complaint of Robert Woodmass, City of London, Insurance Office Keeper (dated 31.1.1787)

Second, amended, bill of complaint of Robert Woodmass, City of London, Insurance Office Keeper (dated 18.6.1788)

- Jonas Brown of Whitby, Merchant, in Sep 1770, possessing severall parcells, messuages etc. was indebted to the complt in the sum of £1500.

- Jonas Brown held a 500 year lease of ground at the south end of the town, on which he erected a warehouse etc.

- JB also held a lease of land on Haggersgate for 900 years

- JB also held a lease of property in Henrietta Street, and also a large stone wharf with crane saw pitts etc..

- All the above properties were assigned as security for the debt of £1500

- All indentures were lost in a fire, and new indentures were granted in 1780

- In 1781, the loan and interest were due to be paid, but Jonas Brown could not pay, and thus it was agreed that the property would be assigned to the complt.

- It was agreed that the property should be sold as soon as possible, but in the mean time it was agreed that the complt would use any rent to reduce the interest on the outstanding debt, and pay any surplus to Jonas Brown. It was also agree that JB would remain in possession for a few months to allow him time to raise the money required to repay the debt

- Approx 1/2 the debt was repaid in 1782 but none has since been repaid.

- Jonas Brown 'confederating with' Edward Cayley, Whitby, Gent., Samuel Pressick, Whitby, Master Mariner, Jonathan Lacy, Whitby, Roper and Jonas Brown the younger, Kingston upon Hull, Merchant, and is refusing to either pay the remainder of the debt, deliver up possession or allow the sale of the property.

Answer of Jonas Brown (dated 15.1.1788)

- admits to the truth of all the statements in the complaint

- EXCEPT that he has not prevented the sale, and has actively attempted to make a sale

- claims that as a proportion of the debt has been repaid, the property is worth significantly more than the £800 which is outstanding.
