Moon v. Miles (1738)


Brief notes only:

Complaint of John Moon of Stockton, Co. Durham, Apothecary & Elizabeth his wife formerly called Elizabeth Miles an infant under the age of 21 yeares by the said John Moon her next friend - dated 14.12.1738


- The complainant Elizabeth's father was Thomas Miles late of Stokesley Gent deceased who held land in Stokesley and Harlsey.

- Thomas Miles had certain other lands in Stokesley in reversion expectant upon the death of Margaret Miles his mother.

- Thomas Miles' Will was dated 31.1.1731, he died shortly after, and it was proved by Margaret Miles and George Prissick.

- Thomas Miles had two daughters, Ann and the said Elizabeth.

- Thomas Miles was indebted to his brother (in law) George Prissick and his wife Anne (who was the sister of Thomas Miles).

- Thomas Miles devised certain tenements in Stokesley (which he had purchased from his brother in law William Hewett) in trust to Margaret Miles and George Prissick.

- John Moon and Elizabeth Miles were married about two years ago.

- Complaint is that Margaret Miles, George Prissick and Ann Miles had not released money & estate etc as required by Thomas Miles' Will, and that they are manipulating the estate to prevent money coming into the hands of John Moon, who requires it for the running of his business.
