Prissick v Booth (1716)

Complaint of Christopher Prissick, London, Surgeon, the eldest son of Thomas Prissick & Mary his wife and John Prissick and Elizabeth Prissick younger children of said Thomas Prissick & Mary his wife, infants, by Christopher Prissick, London, Merchant their uncle and next friend

concerns the rights of the complainants in the estate of great grandfather Thomas Atwell, late citizen and Carpenter of London

main family details are outlined in the notes on the answer (below), with only the additional items gleaned from the complaint included here:

- will of Robert Booth dated 18.8.1707
- Thomas Prissick died 1714.

Severall answers of Thomas Booth def to Bill of Complaint of Christopher Prissick...etc etc as per complaint.

- Thomas Attwell late citizen & carpenter of London by will dated 21.5.1689 ..
 > bequeathed the lease of 9 tenements in St George Bottolph Lane (leased from St Paul) to his daughter Elizabeth Booth wife of Robt Booth, citizen & sadler of London.
 > Annuity to Mary Attwell his wife
 > legacy to grandaughter Mary Booth (now Prissick)
 > legacy to grandsons Thomas Booth & William Booth ( William Booth was born c. Aug 1689, but died before he was 21 on voyage to the East Indies in 1704)
 > copyhold messuage or tenement @ Paddington in Co Bedford to the defdt & his heirs
- Thomas Attwell died c. 1690, and at the time of his death there were approx 42 years remaining on the lease of the properties in St George Bottolphs Lane
- Defendant was born 20.4.1680

- Both Robert Booth (died c. 16.8.1707) & Elizabeth Booth nee Attwell (died c. 10.8.1707) are now decd

- "... the said Thomas Prissick happening some four years after his intermarriage with Mary to fail in the world..." Mary & her children were maintained by & lived with Robert & Elizabeth Booth

- the leasehold property was mortgaged in 1695, and it was believed that this was for the benefit of Mary Prissick & her children

- defendant knows nothing of the legacy of £100 by the will of Edward Reynes citizen & Grocer of London, nor within the will of Hannah Reynes, relict of Edward Reynes

- Although Thomas & Mary Prissick had claimed that Robert Booth made a will naming Mary Prissick as sole executrix, defendant claims fraud & pressure on Robert Booth in the writing of the will.
