of Richard Gowland of Ayton gent brother & heir of Thomas Gowland
deceased who was sonne & heir of Richard Gowland late of Carleton
in the parish of Whorlton yeoman deceased
(Note:

- Richard Gowland the father held land in Carleton to the value of £15 per annum.
- Richard Gowland the father married Margaret Hewthwaite who brought a considerable marriage portion.
- 30 years since Richard Gowland the father did mortgage all or most of his property.
- The mortgage not being paid, George Marwood entered the premises, which descended to Henry Marwood Bart. his sonne & heire
- Henry Marwood conveyed the property to James Woodmass, and it descended to his sonne & heir William Woodmass.
- William Woodmass conveyed the property to Christopher Prissicke/Preswick. The property includes the "house wherein ye said Christopher Preswick now lives together with ye orchard & croft thereto belonging"
-
Complaint maintains that the land should not have been conveyed to any
of the above mentioned, and should have descended to the heires of Richard & Margaret Gowland as per the original marriage settlement.
