Pannell v. Porrett (1745)


Brief notes only:

Complaint of Joshua Pannell late of Scarbrough now of Kingston upon Hull - dated 5.4.1745


- complains that Catherine Porrett of Scarbrough, widow & George Porrett of Scarbrough Gent borrowed £150 from him in 1731 pretending to have security which they did not

- they then released to the complainant property in Conduit Row, Scarbrough on condition that if the money repaid in one year then the property would revert to Catherine Porrett and George Porrett and the indenture would be void

- complains that the money was not repaid but Catherine Porrett and George Porrett have not delivered possession of the property to him, "pretending" that there are prior mortgages (which would take precedence in any action for eviction)
